4. MINUTES OF SPECIAL MEETING OF SLIGO COUNTY COUNCIL HELD ON 24TH SEPTEMBER, 2018:
Councillor Clarke raised an objection to remarks made at the Special meeting, noting that the nominations submitted by him and Councillor Henry had been formally withdrawn and this has been notified to the Councillors and the meetings administrator. Councillor MacManus and Councillor O’Grady asked to be disassociated with the remarks, and the Cathaoirleach stated that it was understandable if some of the rural Members were not able to attend all meetings.

5. PART 8 PLANNING & DEVELOPMENT REGULATIONS FOR UPGRADE OF “T” JUNCTION AT INTERSECTION OF DEVINS DRIVE AND CRANMORE ROAD, ABBEY QUARTER SOUTH:

Councillor MacManus raised a query as to when the works were expected to commence and their duration. In response, Mr. Mícéal McGinty, Cranmore Regeneration Office, stated that works were going to tender in November and it was expected that works would commence before Christmas with a 4-6 week duration.
6. DEMOLITION OF 4 NO. VACANT UNITS AND THE CONSTRUCTION OF 10 NO. DWELLING UNITS AT CONNOLLY PARK, TUBBERCURRY:

Councillor Gormley queried when works were expected to commence. In response, Mr. Seán Martin A/Senior Architect advised that works were expected to start mid 2019.
7. PROVISION OF ASSISTANCE TO THE SOCIETY OF ST. VINCENT DE PAUL, OZANAM TRUST IN THE FORM OF THE CAPITAL ASSISTANCE SCHEME FOR THE CONSTRUCTION OF 8 NO. UNITS AT CUAN IOSA, BALLYMOTE, CO. SLIGO:

The Chief Executive suggested that the Members of the Ballymote-Tobercurry Municipal District could consider bringing forward their bi-monthly Municipal District meeting to 12th November to incorporate budget discussions within the one meeting. The Cathaoirleach agreed to wait until the Chairperson of the Ballymote-Tobercurry Municipal District was present before setting this meeting date/time.
16. DOMESTIC VIOLENCE BILL:
With the agreement of the Cathaoirleach, Councillor MacManus asked that the item on the Domestic Violence Bill be deferred.
17. FINES ISSUED IN RELATION TO A) LITTERING AND B) DOG FOULING:

“To ask for a report outlining the number of fines issued and subsequent revenue raised in years 2015, 2016 & 2017 for (a) littering and (b) dog fouling.
Further, can the Council consider creating a strategy and\or awareness programme around the issue of dog fouling centred on community engagement, education and targeted enforcement actions.”
Mr. T. Kilfeather, D.O.S. outlined information on the number of fines issued/revenue raised in 2015, 2016 and 2017, and provided details of a pilot awareness programme rolled out throughout the county.
Councillor MacManus thanked Mr. Kilfeather for the report and stated that Strandhill and all of the local beaches should be considered for inclusion in the future.
18. HEDGE CUTTING GRANT:

“Can I receive an update on a motion I previously proposed regarding consideration for a hedge cutting grant similar to that available in other local authorities. What view has been formed by the executive on the merits of this scheme.”
Mr. T. Kilfeather, D.O.S. stated that Sligo County Council understands that some counties assist landholders with a grant for facing hedges along public roads e.g. Leitrim County Council. Contact will be made with other local authorities to determine the success or otherwise of their pilot hedge cutting grant schemes. A hedge cutting grant scheme can be piloted in Sligo subject to the allocation of funding for the scheme. The Chief Executive stated that this can be considered during budget discussions.
19. EXTENSION OF PUBLIC LIGHTING ON BALLYMOTE ROAD (R294) IN TUBBERCURRY:

“That the public lighting be extended on the Ballymote Road R294 out of Tubbercurry”.
Mr. Tom Kilfeather informed the meeting that the Tubbercurry Area Engineer can survey this area and prepare a costing for extending the public lighting in the area. However it is unlikely that any funding will be available to carry out this work.
Councillor Gormley expressed her disappointment and stated that this area needed to be looked at. Councillor Mulvey supported Councillor Gormley in her comments.

22. PROVISION OF ON-STREET SEATS OR BENCHES IN BALLYMOTE:

“To ask Sligo County Council to provide a number of on-street seats or benches on the streets of Ballymote.”
Mr. Tom Kilfeather advised the meeting there is no funding to provide Public Benches/Seats in the current year. The cost per seat would be in the region of €1200/€1500. If Councillors proposals were used to contribute towards the costs it is certainly an item that could be considered in 2019.
23. CLOSURE OF POST OFFICES:
With the agreement of the Cathaoirleach, Councillor Casserly asked that the item on the closure of rural post offices be deferred.
25. VOIDS PROGRAMME FOR COUNCIL HOUSES:

“How many council houses are considered to be Void or eligible for the Voids programme within the county and in need of upgrade?
How much funding is estimated to be needed to bring these houses into use?
How much funding has been allocated in 2018 to the Council under the Voids Programme?”
Mr. Joe Murphy informed the meeting that there are currently 67 houses which are considered to be void and which appear to the Council to be eligible for funding under the Voids Programme. The estimated cost to bring these houses back into productive use is €1,348,004. 53 units have been approved by the Department for funding to date at an estimated cost of €1,070,144. Approval for the remaining 14 no. has just been sought (28/09/18) from the Department in the sum of €277,860 (estimated). 29 no. have now been completed.
Voids constantly arise and will continue to rise each year as the Council’s housing stock increase. The Council is vigilant to submitting applications for funding under this scheme regularly and to maximise advantage for Sligo.
27. UPDATE ON THE TAKING IN CHARGE OF ‘WOODSTREAM ESTATE’, COOLANEY:

“To ask Sligo County Council for an update on the taking in charge of Woodstream estate Coolaney.”
Ms. Margaret McConnell, A/D.O.S. informed the meeting that the enforcement section of Sligo County Council is liaising with the Bondholder and their agent in order to ensure the completion the outstanding works necessary to bring the estate up to a standard to commence the process of taking the estate in charge.
28. REQUEST FOR UPDATE RE. CORRIB GAS:

“Now that Sligo is designated a Growth Centre under the National Planning Framework, this Council request an update on what are the possibilities of Corrib Gas being piped to Sligo”.
Mr. T. Kilfeather, D.O.S. advised the meeting that it is an objective of the current County Development Plan to seek the extension of the natural gas supply infrastructure to Sligo. It is understood that there are no such plans at present due the costs involved.
Mr. Kilfeather outlined information on the work carried out under the Sustainable Energy Communities (SEC) Programme and provided details of an application submitted under the Urban Regeneration and Development Fund 2018.
29. FUNDING FOR STUDY ON COURT ABBEY CEMETERY:

“Following on from Minister Boxer Moran’s visit to Court Abbey Cemetery on the 21st August, 2017 where he indicated his Department would provide funding to carry out a study on the dangerous monument in order that conservation works can be carried. I am seeking the support of the council to call on Minister Boxer Moran to honour his commitment and provide the funding necessary”.
Following discussion the Members agreed that a letter would be issued to Minister Boxer Moran in relation to the funding for Court Abbey Cemetery.
30. PROPOSALS FOR IMPROVEMENT WORKS ON A SECTION OF R296 (FROM THE RAILWAY BRIDGE TO PAST THE CEMETERY) IN BALLYMOTE:

“The section of Regional Road 296 from the Railway bridge to past Ballymote Cemetery is in very poor condition and needs improvement works carried out. What plans have the Council to improve this section as it’s a danger to all road users both pedestrians and motorists?”
Mr. Tom Kilfeather advised the meeting that this section of road will be included for temporary repairs in 2018 and is included in the draft 2019-2021 Multi Annual Restoration Improvement Programme.

The Cathaoirleach Councillor Baker rejoined the meeting at this point and resumed the position of chair.
31. AVAILABILITY OF HOUSING GRANTS:

“Update requested on what housing grants are available to the public presently”.
Mr. Joe Murphy informed the meeting that the Housing Grants programme consists of
- Adaptation Grant for People with Disability
- Mobility Aids Housing Grant
- Housing Aid for Older People
- Allocation: €1,600,000
- Council funded element €320,000 (20%)
- Department funded element €1,280,000 (80%)
- Total commitments as at 31/08/18: €1,744,580.
- Applications on hands and still to be approved
€600,000 (estimate)
The Department guidance provides for applications to be categorised fewer than one of three priorities 1, 2 and 3.
Presently applications remain open under Adaptation Grants for People with a Disability and Mobility Aids Housing Grants, priority 1 only.
The Members stressed the importance of these grants particularly amongst the older members of the community and the need for representation to be made at Government level to increase the funding available to local authorities.
32. BAN ON USE OF ‘ROUNDUP’ (GLYPHOSATE) AS A WEED KILLER IN PUBLIC AREAS:

“I call on Sligo County Council to ban the use of Roundup (Glyphosate) as a weed killer in all public areas in Co Sligo”.
Mr. Tom Kilfeather informed the meeting that Sligo County Council like the majority of public sector bodies in the UK and Ireland uses Glyphosate to control weeds on hard surfaces, Parks and particularly invasive weeds. The EU has approved the use of Glyphosate for another 5 years. Given concerns regarding Glyphosate it is understood that Dublin City Council have recently commissioned a trial for alternatives to Glyphosate on a real life like for like situation and a report on any study on viability, safety and effectiveness of the alternative’s would be very relevant to all local authorities. Mr. Kilfeather urged caution and recommended that it would be advisable to await the outcome of any investigations into alternatives to the use of Glyphosate prior to discontinuing its use. It would also be advisable to seek further expert advice on its use prior to deciding to discontinue its use.
Following a discussion, Mr. Kilfeather advised the Meeting that he would update Members when expert advice was to hand.
33. MEDICAL CARDS FOR PATIENTS WITH A CANCER DIAGNOSIS:

“That Sligo County Council, as a matter of urgency, write to the Minister for Health Simon Harris demanding that all patients given a diagnosis of cancer are furnished with medical cards without delay”.
34. PROBLEMS WITH ROAD SURFACE ON R294 AT KNOCKNASHAMMER:

“To ask Sligo County Council to address the problems with the road surface at Knocknashammer on the R294”.
Mr. Tom Kilfeather informed the meeting that the Area Engineer will inspect the location and arrange to carry out any necessary repairs on the road.
10. ENNISCRONE PLEBISCITE:
Ms. Margaret McConnell informed the meeting that correspondence had been received from the Department of Housing, Planning and Local Government (Local Government Oversight and Governance Office) dated 9th August 2018 advising that the Department of Community, Rural and Gaeltacht Affairs had advised the Department of Housing, Planning and Local Government of advice received from the Attorney General during the Dingle plebiscite to the effect that - ‘it may not be possible to alter the name of a place that is the subject of a 2003 Act Placenames Order, by utilising the provisions of either the Local Government Act 1946 or Part 18 of the 2001 Act (if commenced).’
The advice of the Council’s Law Agent, Mr. Bryan Armstrong was sought through a meeting on the 27th August 2018. The legal advice was to await the implementation of the planned legislation.
Having consulted with the CPG at its meeting held on 31st August 2018, it is recommended that in view of the content of the letter from the Department of Housing, Planning and Local Government dated 9 August 2018, and subsequent Legal advice obtained from the Council legal advisor, that the plebiscite process be deferred pending the enactment of the new legislation. The County Sligo Placenames Committee and the Enniscrone Community Development Company will be advised of the position.
Councillor Queenan expressed his disappointment with the delay in conducting the plebiscite.
39. PONTOON DOCK AT DOORLY PARK:

“To receive a progress report on the a new pontoon dock at Doorly Park which will pave the way for the promotion of greater tourist traffic on Lough Gill and in Sligo in general”.
Mr. T Kilfeather DOS advised the meeting that works have commenced on the installation of the new pontoon at Doorly Park. Instream works are underway presently and it is hoped that same can be completed within the coming week, subject to the approval of Inland Fisheries Ireland. Overall construction works are expected to take approximately 14 weeks. Councillor Bree also added his thanks to A/DOS Bartley Gavin and the Sligo Tidy Town Committee for their work on this project. Councillor Keaney added his support to the motion.
48. PSYCHIATRIC UNIT AT SLIGO UNIVERSITY HOSPITAL:

“That Sligo County Council write to the Minister for Health to ask for the commitment of funding to enable the completion of the much needed new Psychiatric Unit at Sligo University Hospital”.
15. SET DATES FOR A) MUNICIPAL DISTRICT MEETINGS TO CONSIDER THE DRAFT BUDGETARY PLAN AND, B) SLIGO COUNTY COUNCIL 2019 BUDGET MEETING:
Following a discussion it was agreed by the Members that the start time for the Ballymote-Tobercurry Municipal District Budget Meeting would be 3.00pm on Monday 12th November, 2018.
The bi-monthly Ballymote-Tobercurry Municipal District Meeting would also be moved from Monday 19th to Monday 12th November to facilitate Members by having the two meetings on the one day.
20. HAZARDOUS WASTE DISPOSAL IN SLIGO:

“To call on Sligo County Council to have open discussions with waste disposal companies to facilitate hazardous waste disposal in Sligo to cover the two new Municipal areas Sligo-Drumcliff and Sligo-Strandhill”.
Mr. T Kilfeather DOS advised the meeting that Greenstar, owners and operators the Civic Amenity Site at Deep Water Quay in Sligo were granted planning permission in 2017 to allow for the collection of household hazardous waste material on site. Given the unprecedented demand for the free disposal of household hazardous waste material at an event held by Sligo County Council in July, it is acknowledged that there is a huge demand to have a permanent facility for the disposal of this material at Deep Water Quay. It is proposed to hold a meeting with Greenstar in October to discuss the logistics and provision of this service in Sligo town and if required, Sligo County Council will write directly to the EPA highlighting the need for a Review of Greenstars EPA Waste Licence to move this issue forward and ensure this service is made available.
Councillor Healy queried if a further hazardous waste collection day would be held before the end of the year. Mr. Kilfeather advised that there was no funding available but that all options would be explored.
21. NORTH SLIGO PUBLIC WATER SUPPLY:

“That Sligo County Council liaise with Irish Water to assess the feasibility of an upgrade for the north Sligo public water supply from the Gortnaleck and Lyle streams.”
Mr. T. Kilfeather, D.O.S. informed the meeting that the response from Irish Water to this motion was dated July 2018. This was during the dry drought conditions. It was agreed that a further update would be requested from Irish Water.
35. TEMPLEHOUSE ROAD L1603-N17 JUNCTION:

“I again call on Sligo County Council and the T.I.I. {Transport Infrastructure Ireland} to re-examine the recently constructed build out works at the Templehouse road L1603 -N17 Junction.
In the last two weeks alone two further accidents have occurred here with one motorist having to be cut out of the vehicle. I have been contacted by and meet with numerous motorists and local residents who have expressed concern about this new junction layout which prior to this work was already a dangerous crossing point but since recent works by the TII it appears to be far more dangerous exiting onto the very busy N17 now.
The N17 is an extremely busy road with thousands of vehicles using it daily from the north west to the west. Local and visiting motorists are finding it increasingly difficult to get safely across and onto this stretch of road at the Temple house junction due to poor sight lines and visibility and due to the excessive speed of oncoming traffic.
The existing signage needs to be addressed also. Local residents are in fear every time they have to exit at this junction and some are having to detour onto to other roads to get out safely onto the N17 which is not acceptable.
At a meeting of Sligo County Council earlier this year, I highlighted this same issue and was informed by senior roads engineer that an independent audit of this location would be carried out. I am again calling on The TII and Sligo County Council to look urgently at this junction before another accident or fatality occurs”.
Mr. Tom Kilfeather informed the meeting that the N17 road is a very busy road, with particular problems at the junction with regard to sightlines. An independent Road Safety Audit identified only minor issues that can be addressed. Some land acquisition at the junction along N17 is required in order to improve the sightlines; Sligo County Council will make further efforts to improve the sight line problems.
36. TRAFFIC CALMING ON THE SHORE ROAD, STRANDHILL:

“That Sligo County Council consider putting traffic calming measures in place on the Shore Road, Strandhill”.
Mr. T Kilfeather DOS informed the meeting that Roads personnel will seek to carry out a review of traffic volumes and speeds along the Shore Road in Strandhill. This information will be used to determine the need for traffic calming at this location.

“To ask the C. E. O. what are the advantages for Sligo County Council in its efforts to provide Social and Affordable housing following the announcement of the National Land Development Agency”.
Mr. Joe Murphy, A/DOS advised the meeting that the Government launched the Land Development Agency (L.D.A.) on 13 September, 2018 with the aim of building 150,000 new homes over the next 20 years. Its immediate focus will be on managing the State’s own lands to develop new homes, and regenerate under-utilised sites. In the longer-term it will assemble strategic landbanks from a mix of public and private lands, making these available for housing in a controlled manner. All public land that is sold to developers must deliver at least 40% of any housing potential on such lands in the form of social (10%) and affordable (30%) housing. This initiative is very welcome although currently short in detail. It is too early to indicate what the advantages will be to this Council.
Councillor MacManus stated for the record that it was his opinion that the new agency would hamper the supply of public housing due to its over reliance on the private sector. Local Authorities needed to be funded properly to develop the site and have the procurement process reformed.

In response to the motions Mr. T Kilfeather DOS informed the meeting that the Consultants Report is completed and a briefing for all interested parties is expected to take place in next fortnight. The Council has kept in regular contact with OPW to advise of progress and to ensure that the funding of €50,000 allocated by Minister Moran’s Office remains available. He advised that correspondence has been received from OPW last week recommending to their own Engineering section that the monies are released on completion of the works. OPW has also acknowledged in writing that they recognise seasonality will affect the ability to carry out works in the short term.
Councillor Healy added his support to the motions and highlighted the need for the drainage works to be extended further downstream. Mr. Kilfeather advised the meeting that it is the OPW who are responsible but the Council will attempt where possible to assist in instances where there are issues arising regarding debris in the river.
41. PEDESTRIAN CROSSING ON THE BUNDORAN ROAD:

"That Sligo County Council engineering staff would place a controlled Pedestrian Crossing on the Bundoran road to accommodate the large numbers of people young and old that cross the road to access Shops and Food outlets".
Mr. Kilfeather advised that the up-coming N4/N15 Urban Improvement Scheme incorporates a controlled pedestrian crossing immediately north of the N15 / R291 (Rosses Point Road) junction. It is proposed that a second controlled crossing will be provided adjacent to the pedestrian access from Cartron Estate onto the N15 at the Circle K (former Topaz) Service Station. This scheme is scheduled to commence during the early part of 2019. In addition to this, the pavement strengthening scheme which commences shortly on the N15 at Shannon Eighter will make provision for the future installation of a controlled pedestrian crossing in the vicinity of the Texaco Filling Station. A separate funding application will be submitted to TII in 2019 for the installation of the associated above ground infrastructure (i.e. pedestrian signal heads, poles and push button units).

44. ONLINE REGISTER OF DEFIBRILLATORS:

“Recognising the increased placement and usage of automated external defibrillators (AEDs) in communities right across not only this County but across the State, that this Council calls upon the HSE to instigate an online register of their locations. Subsequently, utilising smartphone technology, an app should be designed to allow first responders to locate the nearest AED at any given time, thus increasing the possibility of saving lives.”
45. SOCIAL HOUSING:

- The number of applicants on Sligo County Council’s Social Housing List;
- The number of Council owned houses throughout the County;
- The number of void Council owned units brought back into social housing use since January 2017 and the number of void units outstanding;
- The number of households that Sligo County Council are assisting through either HAP, RAS or any other social payments to those accessing ‘social housing’ via the private rental sector;
- The cost to the public exchequer of the payments outlined in (d) for 2017 and 2018 (to date)
- A list of the location and size of all unused [that has not been subject to a Part 8 Planning Process] landbanks owned by Sligo County Council;
- Outline efforts that Sligo County Council have made to use their compulsory purchase powers to bring vacant and derelict properties back into use for social housing?
Further, recognising that there is a Housing Crisis and a chronic shortage of Social and Affordable Housing, that this Council calls on the Executive to outline proposals to address this issue by:
- Bringing outstanding void Council Houses back into use;
- Bringing forward proposals to utilise unused landbanks as per (f) for social and affordable housing;
- Using CPO powers to bring vacant and derelict properties back into use for social housing if this process hasn’t already begun.”
Mr. Joe Murphy, SEO Housing, provided a report setting out the information under the various headings. He advised Members that that there are 1154 households on the housing waiting / transfer waiting list at 25th September and that a total of 556 - HAP Accommodated and approved for a transfer.
The Housing Stock as at 31/08/2018 is 2177 (excludes redundant and leased stock), and in 2017 there were 67 no. funded under the Voids Programme and brought back into productive use (68 no. in 2016). 4 no. funded directly by the Council.
The total number on RAS is 425 households and the total number on HAP as at week 10/9/18 is 598 active HAP Tenancies, with the Council recouping €2,855,890.79 from the Department for RAS in 2017.
Mr Murphy added that the Council is very active in acquiring houses in the housing market over the last number of years, to include Part V houses, and work is ongoing in bringing outstanding VOID housing back into use.
24. PROVISION OF RECYCLING BINS:

“Sligo County Council will seek an environmental awareness grant or alternative funding to secure recycling bins for the shorefront at Strandhill, Rosses Point and a number of trial locations to establish if they can be rolled out across the county.”
Mr. T. Kilfeather, D.O.S. advised the meeting that the issue of waste segregation is high on the agenda both from the Local Authority and Department perspective. Currently there are public bins in place at various locations throughout the county, but the destination for items disposed of in these bins is landfill. It is acknowledged that a high percentage of what’s disposed of in these bins is of recyclable or food waste nature, therefore the provision of segregated recycling bins would be of great benefit if used correctly.
There are currently no environmental awareness grants available for the provision of this type of recycling system, however, given the fact that there is a large emphasis in the Dept placed on the promotion of ‘Keep Cups’ and recycling in general, funding may be made available in 2019. If this is the case, Sligo County Council may consider submitting a funding application to secure recycling bins for the shorefront at Strandhill and Rosses Point as trial locations. Discussions will also be required in-house regarding any additional costs associated with staffing resources and waste collection in general.

26. WASTE WATER TREATMENT PLANT AT STRANDHILL:
“Sligo County Council will engage with and lobby Irish Water and the E.P.A. to upgrade the current wastewater treatment works at Strandhill to include UV treatment.”

The Head of Finance Ms M Whelan stated that this matter had been covered at the June 2018 ordinary meeting and that the position had not changed. For clarity she outlined the details again. The current analogue microphone system in the Council Chamber is incompatible with the implementation of live streaming and would require an upgrade at an estimated cost of €25,000-€30,000.
With this in place live streaming would cost an additional estimated €20,000 per year based on our current meetings profile. This excludes municipal district meetings. No financial provision for live streaming has been made in the current year.

Mr. T Kilfeather DOS stated that Sligo County Council does not allocate specific funding for coastal protection works except that needed as matching funding to OPW grants for particular projects.
Sligo County Council has applied to OPW for a number of coastal protection projects in West Sligo The OPW have recently sought additional information and further design regarding these schemes. So far no funding has been allocated to coastal protection works in West Sligo in 2018.
A discussion followed among the Members and Councillor Queenan proposed that a delegation go to meet the Minister on the issue.
The Chief Executive noted that the Local Government sector had recently concluded a report on the issue of coastal erosion which had been submitted to the OPW with a request for them to take the lead on the issue. However they were unsuccessful in that regard and the report is now with the Department for a decision on the matter. It was then:

Mr. T Kilfeather DOS informed the meeting that funding was allocated in 2018 by the Department of Rural and Community Development for Local Authority Measures –
Measure 1 related to “Support for Schools/Community Safety” measures
Measure 2 related to “Support for Play Areas”.
A number of applications were received under both Measures and they were prioritised based on the Scheme criteria and forwarded to the Department of Rural and Community Development. The Council could only apply for up to 15 projects but we submitted a Reserve List under both measures in case additional funding became available during 2018. Applications for Stokane Community Park group, Kilglass N. S Board of Management and Rathlee N.S Board of Management were made under Measure2 Play Areas Reserve List.
The Council will have to wait until 2019 to see if funding is allocated under the Clár 2019 – Local Authority Measures.
55. PEDESTRIAN CROSSING IN BALLISODARE:

57. TRAFFIC CALMING WORKS AT COLAISTE MUIRE SECONDARY SCHOOL, BALLYMOTE:

Mr. T Kilfeather DOS advised that the Area Engineer can meet with the Principal and members of the Board of Management to discuss any road safety issues at the school entrance. However, there is no funding to carry to any major works in the current year.
