THIRD  CHIEF EXECUTIVE’S REPORT ON SUBMISSIONS AND OBSERVATIONS ON THE PROPOSED AMENDMENTS OF THE DRAFT COUNTY DEVELOPMENT PLAN 2017-2023:

SECTION 1 –CONSULTATION ON PROPOSED AMENDMENTS:

Ms. D. Clarke outlined to the Meeting the stages the Plan had been through to date.

At the Meeting, recommendations on proposed amendments to Volume 1 would be dealt with by Ms. Davidescu, the Recommendations on proposed amendments to Volume 2 by Mr. Ward and Recommendations on proposed amendments to the Record of Protected Structures by Mr. Moylan.

Ms. Davidescu referred to Section 1 of the report which had been previously circulated to the Members.  This dealt with Consultation on the Proposed Amendments.

Members’ attention was drawn to, and clarification given regarding, items under the following headings:

1.1    Submission received from the Department of Housing, Planning, Communities and Local Government,

1.2    Submissions not related to the proposed amendments,

1.3    How the Chief Executive’s Report is organised,

1.4    The role of the Elected Members,

1.5    What happens next.

The Members were advised by Ms. Davidescu that, should they adopt the Plan at the Meeting, it would come into effect four weeks after that date, i.e. 28th August, 2017.

Councillor Clarke sought clarification regarding submissions received from members of the public. Ms. Davidescu drew the Members’ attention to page two of the report, item 1.2 where “Submissions not related to the proposed amendments” were listed.

The Chief Executive further clarified, in reply to points made by Councillor Clarke, that the suggestion at a previous meeting of going back to Stage 2 of the County Development Plan process was withdrawn following an adjournment of the meeting to consider the matter in conjunction with the Senior Planner. 

The Senior Planner then clarified that the example cited in relation to Donegal County Council extending their deadline for submissions was due to an incorrect e-mail address being issued on their public notice.  This had impacted on the public’s ability to make valid submissions.  They had then given an extended period of time in which submissions can be made.

The Chief Executive concurred that, in Sligo County Council’s case, the process had already passed that stage and that was why the proposal to go back to stage 2 had been withdrawn.

A further discussion ensued in relation to the Draft Plan’s timescale and process.

 

THIRD CHIEF EXECUTIVE’S REPORT ON SUBMISSIONS AND OBSERVATIONS RELATING TO THE DRAFT COUNTY DEVELOPMENT PLAN 2017-2023

SECTION 2 –RECOMMENDATIONS ON PROPOSED AMENDMENTS TO VOLUME ONE OF THE DRAFT COUNTY DEVELOPMENT PLAN:

Ms. Davidescu, A/S.E.P. then advised the Meeting that each amendment would be considered individually.  For each amendment, in the right hand column, it was indicated whether a submission had been received or not.  The Chief Executive had recommended that the proposed amendment should be adopted.  It explained what the submission requested or suggested and gave opinion and recommendation.

In going through each item individually, the Members would have to indicate whether they agreed or rejected the recommendation.

In reply to a query from Councillor Queenan in relation to coastal erosion works and responsibility for same, the Chief Executive referred to the various Agencies involved. 

Ms. Davidescu drew the Members’ attention to page 23 of the report, A-10-3 as agreed above “In Section 10.4 Coastal environment, subsection 10.4.4 Developments on the foreshore and near shore (p.173 of the Draft Plan) replace the definition of the foreshore with an extended version”.

Legislation will align the foreshore system with the planning system and identify the roles of who is responsible for the various elements.

In reply to an enquiry from Councillor Queenan in relation to A-13-6 (Residential development in rural areas), delete Table 13.A which details some principles of vernacular rural house design, Ms. Davidescu confirmed that it had been amended and included in Appendix 1 of the Report.  This is only a guide and is not mandatory or compulsory, but the Senior Planner noted that such information is regularly requested by applicants.

AMENDMENTS TO SCENIC ROUTES:

“The amendments made to scenic routes in the Ballymote-Tubbercurry area in the Second Manager’s Report be removed and the scenic routes to remain as was in the previous Plan”.

In reply to issues raised in relation to this item, the Senior Planner indicated that while he appreciated their concerns, this is a procedural issue and the amendment cannot be legally made at this stage of the process.

Following a discussion on the matter, the above resolution was withdrawn by the proposer and seconder.

 

ADOPTION OF THE SLIGO COUNTY DEVELOPMENT PLAN 2017-2023:

“Having considered the proper planning and sustainable development of the area to which the Development Plan relates, the statutory obligations of the local authority and any relevant policies or objectives for the time being of the Government or any Minister of the Government,

AND having considered the Draft Sligo County Development Plan 2017-2023, the Proposed Amendments and the Third Chief Executive’s Report on submissions and observations received under Section 12 (8) of the Planning and Development Act 2000 on amendments (material alterations) proposed to the Draft CDP 2017-2023,

It is hereby resolved to adopt the Sligo County Development Plan 2017–2023 and to make the Plan in accordance with Section 12(10)(a) of the Planning and Development Act, 2000, subject to the Third Chief Executive’s Report and modifications to the amendments, as proposed and adopted at this meeting of 31 July 2017. 

The proposed amendments to the draft Development Plan are adopted unless otherwise agreed at this meeting.”

Councillor M. Clarke asked that it would be recorded that he abstained from the agreement of the above resolution.

The Chief Executive extended his thanks to the Cathaoirleach for taking the Plan through its third stage and to previous Cathaoirleach, Councillor Keaney.  It was noted that a considerable body of work had been done over the last number of years and the Chief Executive paid tribute to Ms. D. Clarke, Director of Services, the Senior Planner and Planning Staff.

FUNDING FOR COOLANEY MOUNTAIN BIKING TRAIL:

Councillor Mulvey wished to record the Council’s thanks to the Minister for Rural and Community Development, Deputy Michael Ring, for the allocation received for various projects in County Sligo.

Included in the allocation is the sum of €840,000 towards the National Mountain Biking Centre at Coolaney. 

Members noted that this was a most welcome development for Sligo and the north west region.

 

FUNDING FOR CLASS III ROADS IN COUNTY SLIGO:

The Cathaoirleach advised the Meeting that Councillor Gormley had earlier requested an opportunity to highlight this matter.  With the Cathaoirleach’s consent, Councillor Gormley, in welcoming the funding notified earlier, expressed her disappointment at the lack of progress in meeting with the Minister for Transport in relation to this matter.
