16. EXTEND SEWAGE SYSTEM IN FORLAND, EASKEY TO SERVICE 27 NO. HOUSES:

In response, Mr D. Harrison, Acting Senior Engineer stated the following:
This proposal relates to the extension of the sewer collection network in Easkey for a distance in excess of 1.1km in the townland of Fortland. The preliminary cost estimate for these works is €280,000.
Unfortunately there is no funding in the O&M budget or in existing capital allocations to carry out this work at present, however, the Council will keep this matter under review.

18. PREVENT ILLEGAL DUMPING AT MOUNTAIN VIEW, TUBBERCURRY:

“That action is taken by this Council to prevent the illegal dumping that is presently taking place at Mountain View, Tubbercurry by erecting a boundary wall and that the site be cleaned up as it is a health and safety issue”
In response, Ms. D. Clarke Director of Services stated the following:
Under the Litter Pollution Act 1997 as amended by the Waste Management (Amendment) Act 2001 and the Protection of the Environment Act 2003, Sligo Local Authorities are responsible for implementing the litter laws in County Sligo. This means we are responsible for the prevention and control of litter.
Sligo Local Authorities are responsible for keeping public places that are under our control, (including public roads), clear of litter as far as is practicably possible. However, the site in question which is adjacent to Mountain View is privately owned and therefore is the responsibility of the landowner to maintain. Sligo County Council is not in a position to erect a fence or wall without the permission of the owner. The registered owner of this property has been deceased for over 10 years. We have passed this detail on to the Environment section to investigate who the current owner is and serve notice on this person.
19. REQUEST GOVERNMENT TO RETAIN WESTERN DEVELOPMENT COMMISSION:

“That in recognising with deep concern the disproportionate effects that the current Economic recession is having in Sligo and all areas of the west of Ireland, that this Council give its full support to the submission made by the Council for the West to the Department of Community, Equality and Gaeltacht Affairs titled "A Case for the Retention of the Western Development Commission” and to call on the Minister for Community, Equality and Gaeltacht Affairs to retain the Western Development Commission to allow them to continue their great work in the current economic crisis and climate”

In response, Mr J. Murphy, Senior Executive Officer stated the following:

Possible effects:
Article 6 of the Habitats Directive (92/43/EEC) sets out the provisions which govern the conservation and management of Natura 2000 sites (ie. SAC’s and SPA’s) and requires that:
‘Any plan or project not directly connected with or necessary to the conservation of a site but likely to have a significant effect thereon, either individually or in combination with other plans or projects, shall be subject to appropriate assessment of its implications for the site in view of the site’s conservation objectives.’
In summary, prior to any decision been made to allow any plan or project, an assessment of its potential impacts on the network of Natura 2000 sites across the County must be undertaken. This process is known as an appropriate assessment and involves a number of steps and tests that need to be applied in sequential order.
The first stage in the process involves the screening for appropriate assessment and involves the planning authority determining whether the proposed development is likely to have a significant effect on a Natura 2000 site. In many instances, it will be clear to the planning authority that because of the location, nature or extent of the proposed development, a full appropriate assessment is not required as there is no potential for significant effect on a Natura 2000 site. Accordingly, in respect of the requirements of the Habitats Directive, the project can proceed as proposed.
For example, in the case of a proposed dwelling house, it may be located so far away from any Natura 2000 site, that it is certain that it will not have a significant effect on the adjacent protected site. In addition, given that the network of Natura 2000 sites is comprised of our most vulnerable areas e.g. rivers, wetlands, upland areas, coastal zones etc., they are not generally locations where one-off housing would be encouraged. In this regard, the current County Development Plan 2005 - 2011 already contains an objective to ‘discourage development that would destroy or damage any sites of international or national importance, designated for wildlife / habitat significance, including pNHAs, cSACs and SPAs’.
It should be noted that the 15km distance relates to statutory land use plans (e.g. county development plans or Local Area Plans) and not individual applications for planning permission which must be evaluated on a case by case basis with reference to the nature, size and location of the proposed development. -
Additional Costs
Additional costs are only likely to be incurred by an applicant where full appropriate assessment is required to be undertaken i.e. the proposed development is likely to have a significant effect on a Natura 2000 site. In such circumstances, the applicant will be required to submit information which may require the applicant engaging the services of a professional with expertise in a particular field e.g. an ecologist, hydrologist etc.
However, the applicant in consultation with the planning authority may be able to identify alternative solutions which do not require a full appropriate assessment. For example, in respect of a proposed dwelling house, it may be possible to identify alternative sites within the overall landholding which because of their distance from the Natura 2000 site will not have a significant effect on the adjoining Natura 2000 site. -
Pre-planning
At pre-applicant stage, applicants and their agents are currently being informed of the location of Natura 2000 sites, the availability of information about these sites, and of the implications they may have for the proposed development. In addition, in some cases where, for example, the proposed development is located within or immediately adjacent to a Natura 2000 site, the planning authority will advise the applicant to consult with the National Parks and Wildlife Service. It is at this pre-planning stage that opportunities for relocation, redesign or other mitigation measures may be revealed that would avoid any negative effects on a Natura 2000 site arising.

21. ENDORSE AIMS AND OBJECTIVES OF RURAL IRELAND SAYS ENOUGH CAMPAIGN:

“That Sligo County Council endorses the aims and objectives of the RISE (Rural Ireland Says Enough Campaign) and the Council notes the increasing level of popular support being expressed for the Campaign and shares the concerns it is highlighting over several pieces of legislation currently being proposed by the Minister for the Environment, Heritage and Local Government John Gormley, TD. This Council calls on the Minister to listen to the concerns being expressed and involve stakeholders in full consultation”
It was agreed to amend the motion by adding the following:
“And that Sligo County Council would no longer accept any further interference or restrictions on the Harmless outdoor rural pursuits”
22. REQUEST NEGOTIATIONS TO REDUCE CHARGES OF EIRCOM POLE REMOVAL:

“The location of poles carrying telecom lines along county roads has presented major difficulties for the Council and Individuals because of very high charge being levied for removal where necessary, I request that negotiations take place with the view to reducing charges”
In response, Mr. S. O’Toole, Senior Executive Engineer stated the following:
Negotiations are ongoing with Eircom with a view to arriving at a satisfactory solution to this problem. However, we have no control over any charges that Eircom levy on individuals.
Mr H. Kearns, County Manager stated that the location of some Eircom poles were a major public safety issue that had to be addressed and the onus was on the planning applicant to comply with planning permission which often meant the removal/relocation of these poles for safety reasons. He further suggested that legal advice on the matter should be sought as to whose responsibility this matter falls under.

23. REPORT ON PROPERTY RENTED BY COUNTY COUNCIL:

“That the Council be provided with a report providing details of each property which the Council is currently renting, the owner of the property, the purpose for which the property is being used, the annual rent being paid, the terms of the lease agreement and the rental cost per square metre”

24. PROPOSED NEW SLIGO LIBRARY HEADQUARTERS:

“To ask the Director of Services to outline the mechanisms, timescale and site proposals for the delivery of the new Sligo Central Library and HQ project as adopted in the Library Development Plan 2006 – 2010”
In response, Ms. D. Clarke Director of Services stated the following:
The provision of a new Branch Library and Headquarters for the Library Service is now our next priority in the context of he current Library Development Plan. It is anticipated that Ballymote Branch Library will be operational towards the end of 2010. The provision of a new Library for Sligo was to be incorporated in the overall masterplan for the development of the Cultural Quarter on the Mall. Due to the downturn in the economy this development is not now a possibility in the short to medium term. A feasibility study done in relation to the current Stephen Street site indicated that the current site was restrictive in terms of the location of a new facility there. We are exploring with An Comhairle Leabharlanna how best we can proceed from here. There are perhaps a limited number of options available to us. Due to the availability of vacant commercial/office properties in the town centre we will be exploring the possibility of providing new Library facilities either through the acquisition of a suitable property or perhaps through a long term lease arrangement similar to what we have in Ballymote. This is dependent on a viable suitable property being available in the right location, i.e. in the town centre or within a reasonable distance thereof. The approval of An Comhairle Leabharlanna would also be required together with adequate grant funding. It is our intention to proceed with this over the next few months.
It was agreed that this item would be referred to the relevant SPC.
25. REQUEST REPORT ON INTEREST PAID ON OVERDRAFT FACILITY AND COUNCIL LOANS:

27 REQUEST GOVERNMENT TO EXPEDITE APPROVAL FOR FUNDING FOR CUMMEEN DRAINAGE SCHEME:

Cummeen Sewerage Scheme is included in the new Water Services Investment Programme 2010 – 2012 as part of the scheme titled Sligo & Environs Sewerage Scheme. This scheme is listed in the category Schemes at Planning Stages. Sligo County Council is currently awaiting Department approval of the Design Review Report for this project.
28. REQUEST THE GOVERNMENT TO REPORT ON TRANSFER OF CANCER SERVICES FROM SLIGO GENERAL HOSPITAL:

29. REQUEST FITTING OF BACK BOILERS IN COUNCIL HOUSES:

“To ask Sligo County Council to fit back boilers for heating purposes in a number of Council Houses at Dun a Rí, Ballintogher, Co. Sligo”
In response, Ms. D. Clarke Director of Services stated the following:
Sligo County Council would not recommend installation of Solid fuel back boilers at Dun na Ri, Ballingtogher for the following reasons:-

Oil heating is the main heating system for these houses
-
In terms of building energy ratings, solid fuel performs less favourably than oil heating.
-
Solid fuel smoke emits more CARBON DIOXIDE into the atmosphere than oil, smog conditions could evolve in cold weather, creating unhealthy conditions particularly in urban areas.
-
Oil heating can be controlled on a demand basis only Solid fuel heating can’t. Significant cost savings can be made by a tenant using the former.
30. REQUEST REMOVAL OF 2 NO. CONTAINERS AT UNION PLACE, COLLOONEY, CO SLIGO:

“To ask Sligo County Council to provide a date as to when the two forty-foot containers will be removed along the side of road at Union Place, Collooney, Co. Sligo”

Steps have been taken by the Area Engineer to have these containers removed and it is hoped they will be gone soon.
31. REPLACE CATTLE GRID AT ENTRANCE TO DUNMORAN BEACH:

“That this Council replace cattle grid at entrance to slipway at Dunmoran Beach, as the existing grid is very dangerous and unsafe”
In response, Mr. S. O’Toole, Senior Executive Engineer stated the following:
The grid at the entrance to Dunmoran Strand has been damaged for some time now. The Area Engineer will prepare an estimate for its replacement. However, no funding is available for this work in the current year.
32. UPDATE ON TAP WATER SUPPLY AT DUNMORAN:

“I will ask at the next meeting for an update on a Tap Water supply at Dunmoran”
In response, Mr D. Harrison, Acting Senior Engineer stated the following:
Sligo County Council is required to recover the cost of providing water services to the non-domestic sector. This is in accordance with National and EU policy on the application of the polluter pays principle. There is no provision in the Councils’ budget to fund the ongoing cost of individual non-domestic water supplies.
33. REQUEST HEDGECUTTING AT N17 AT CARROWREILLE OLD SCHOOL:

“That steps be taken immediately in the interest of safety to have the vegetation that is obstructing the view of motorists exiting out onto the N17 at Carrowreille old school and the junction opposite it cutback before there is a serious accident”

This junction will be examined to ensure that sightlines here are preserved.
34. REQUEST THE GOVERNMENT TO REVIEW PENALTIES FOR DRINK DRIVING OFFENCES:

35. REQUEST GOVERNMENT TO ENSURE COURT SITTINGS AT EASKEY COURT HOUSE:

36. IMPROVE CAR PARKING ALONG N59 AT CORBALLA CHURCH:

“To ask the Director of Services to carry out works to improve car parking along the N59 alongside Corballa Church and to ask for an update regarding the reduction of speed limit on the N59 at Corballa Village?”
In response, Mr. S. O’Toole, Senior Executive Engineer stated the following:
No funding is available to improve car parking along the N59 at Corballa. In relation to possible speed limit in Corballa, a reply is expected from the NRA soon.
Mr T. Kilfeather, Director of Services indicated that every small job costs and the demands on staff were far in excess of what the Council could meet financially. It was agreed to discuss this item at the next Dromore West Electoral Area Meeting.
37. ENFORCE PL NO. 1286 TO IMPROVE SIGHTLINES OFF ROAD 163 ONTO R297:

“To ask the County Manager to indicate what powers do the Enforcement Section have to ensure that sightlines are improved off Road163 onto R297, which is a condition of PL No. 1286”
In response, Mr J. Murphy, Senior Executive Officer stated the following:
This relates to PL 07/1286 – Planning permission granted on 24/09/2008 for a dwelling house, double domestic garage, P.E.T.S and percolation area and to carry out ancillary site works at Carrowcardin, Enniscrone, Co Sligo. This development has not been commenced and therefore the Enforcement Section cannot enforce the planning condition relating to set backs along both the Regional Road and the County road.
Mr. S. O’Toole, Senior Executive Engineer stated that the landowner would be approached in relation to improving sightlines.
31. PROVIDE COSTING FOR FOOTPATH AND LIGHTING FROM OXFIELD PARK TO CARNEY VILLAGE:

44 . MATTERS ARISING:
There were no matters arising from minutes.
45. ANY OTHER BUSINESS:
Councillor M. Lyons sought clarification on the Councils’ hedgecutting programme, this was noted by the Meeting.
Councillor G. Murray expressed his good wishes to Mr Syl Mulligan, Machinery Yard Technical Services Supervisor who was due to retire at the end of the Summer after almost 20 years service with Sligo County Council.
All of the Members paid tribute to Mr Mulligan for his dedicated service. The County Manager also paid tribute to Mr S. Mulligan and wished him well on his retirement.
Mr F. MacNabb, Meetings Administrator brought to the attention of the Members, a meeting regarding INTERREG Cross Border Disability Access Initiative to take place on 22nd July, 2010 in the Slieve Russell Hotel, Cavan. It was agreed that Councillor M. Lyons and Councillor T. Collery, ICBAN Representatives would attend same.
