It was agreed that Items 8, 9, and 10 be considered together.
8. TO CONSIDER THE WESTERN RIVER BASIN DISTRICT MANAGEMENT PLAN:
At the outset, the County Manager advised the meeting that the reports for the Western, North West International and Shannon River Basin Management Plans were previously circulated to Members and discussed at a special meeting of the Council on 29th March and that Sligo County Council under the Water Policy Regulations must make a plan for each. He stated the financial implications of the plans were impossible to quantify.
9. TO CONSIDER THE NORTH WEST INTERNATIONAL RIVER BASIN MANAGEMENT PLAN:
A general discussion took place and Members queries were answered. In relation to the timeframe for adopting the plans, the County Manager stated that the Regulations governing these are set out under the EU Water Policy Regulations 2003 and Amendment Regulations, 2010 which sets out under Article 13 that a plan must be put in place by Members no later than 30th April, 2010, otherwise the County Manager is obliged to adopt the plans by May, 14th 2010. He further stated that Members could make suggestions/comments to the Minister in relation to the Plans.
Mr F. O’Driscoll, Acting Senior Engineer advised Members that these Plans included measures of current legislation like the EPA Code of Practice. In relation to the cost implications of the plans he said the plan addresses this as follows: (WRB - Foreword Page 3)
“Following adoption of this plan, local authorities will develop implementation programmes and identify all resource implications and funding requirements. It is likely that the resource requirements will exceed the current capacity of Local Authorities. Meeting the commitments contained in the plan will depend on the Department of the Environment, Heritage and Local Government together with other Government Departments making provision for the required resources and funding”.
Following further discussion, the meeting agreed a 5-minute adjournment.

10. TO CONSIDER THE SHANNON RIVER BASIN MANAGEMENT PLAN:

“That this Council declares its opposition to the imposition of Domestic Water Charges and the imposition of license fees for septic tanks and further the Council resolves to amend the “Final River Basin Management Plan for the Western River Basin District in Ireland (2009-2015) and the North West International and Shannon River Basin Management Plans by deleting:-

The following text in Paragraph 5.2.4 (page 66 WRB) “Following a recent Government decision, legislation is to be introduced by the Minister for the Environment, Heritage and Local Government to enable local authorities to charge domestic users for water services in a manner which provides incentives for efficient water use and which recovers an adequate contribution of the costs of water services. Proposals will also be brought forward for a metering programme for domestic users.”

The following text in the Action Programme under the heading ‘Cost Recovery for Water Services’ (page 101 WRB) “Introduce legislation to allow local authorities to charge domestic users for water services. Develop charging methodology for water services and introduce water charges for domestic users.”
In addition Sligo County Council calls for the immediate re-establishment of the River Basin District Advisory Councils and further it calls on the Government to ensure that elected councillors are represented on the National Advisory Committee which is to be established to oversee the national implementation of measures contained in the River Basin Management Plans.”
The County Manager indicated that it appeared the Regulations did not allow Members to make any variation of the plan and indicated that Cllr Bree’s Motion may not be in order. Councillor Bree pointed out that the adoption of the River Basin Management Plans was a reserved function. In response, the County Manager indicated that it was his duty as Manager to advise Councillors on their reserved functions, which was his intent.

15. PRESENTATION BY IDA AND ENTERPRISE IRELAND:
Mr Joe McHugh, Regional Manager IDA Ireland and Mr Conor Fahy, Regional Director Border Region, Enterprise Ireland gave a presentation to the Council.
The County Manager expressed his thanks to both speakers and assured both bodies that Sligo Local Authorities would continue to work alongside both Agencies in improving Sligo’s Infrastructure and improving its attractiveness to invest for businesses. Members also thanked both Agencies for their presentation.

18. PRIORITISE RURAL COTTAGES AND IMPROVEMENT WORKS IN LIEU UNDER 2010 HOUSING PROGRAMME:

“To ask the Director of Services to make Rural Cottages and Improvement Works in Lieu Schemes a priority under the 2010 Housing Programme.”
In response, Ms. D. Clarke, Director of Services stated the following:
The Department of Environment, Heritage and Local Government have advised that the Housing Capital Allocations for the next number of years will be significantly reduced. Our capital allocation for 2010 is expected to be much less than what we received in 2009. (€11m was received for our Housing Capital allocation in 2009 of which €7m was earmarked for construction/acquisition)
The Department have also emphasized that our priorities for delivering on social housing for those people on our waiting list should be on the Long Term Leasing Scheme and on RAS (Rental Accommodation Scheme) rather than on our construction programme.
At this stage it looks as it there will be no new build or a construction programme in 2010 or over the next number of years. Project briefs for schemes in Ballintogher, Collooney and Easkey and Connolly Park which we would have forwarded to the Dept in 2008 will more than likely not be approved for advancement this year.
For 2010 our social housing programme will be focused on the following:
-
completion of exiting build programmes: (18 houses on Mountain Road to be completed)
-
delivery of Part V units at Enniscrone (7Apts) and Ballisoadare (3 Houses)
-
delivery of rural houses (approx 4 or 5 to be delivered )
-
completion of extensions and IWILS subject to funding availability and
-
house purchases in exceptional cases.
-
Energy Enhancement works on approx 15 houses.
-
Works to improve and enhance Connolly Park, Tubbercurry prior to progressing to next Phase.
It is anticipated that Funding to start and progress the Voluntary Housing Scheme by Sophia Housing Association in Tubbercurry under the CAS (Capital Assistance Scheme) will be forthcoming in 2010.
Since January 2010 we have advertised for long term leasing options with property owners in the County with a view to leasing suitable properties for people on our housing waiting lists. All applications will be dealt with promptly and will be subject to Department approval.
Notice of our actual capital allocation for Social Housing Investment Programme is awaited form the DEH&LG.
In 2009 the Department funded Improvement Works in Lieu from the capital allocation. We have been told that this will not be the case for 2010. As a result the majority of the funding for IWILS must come from Internal Capital Receipts. This is the receipts from Tenant Purchases in the year. ICRs are allocated across a number of headings including IWILS so the level of funding available is not significant. (471,000 in total)
19. REQUEST THE GOVERNMENT TO EFFECT NO FURTHER CUTBACKS ON ARTS FUNDING:

“Cut backs in funding to the arts have had exponentially devastating effects on artists and venues throughout the country. In the Sligo area alone 5 of the key arts concerns have lost close to €250,000 in total between them, an average of 20% being cut from each organisation. This pattern is being repeated throughout the country, with up to a fifth of an annual budget being taken from organisations that were desperately underfunded and resourced to begin with. Jobs are being cut, venues are being closed, artists and the value of their work is being lost to our country and culture, our collective heritage is being sacrificed. With one of the lowest per capita levels of investment in the Arts in Europe to begin with, it is a sad irony that at the same time this damage is being inflicted, culture and the arts are widely recognised as being one of the key potential driving forces behind the social, moral and economic recovery of the nation in the years ahead. This motion asks the Council to call on the Government to effect no further cutbacks or curtailment on funding to the arts and at its earliest opportunity it calls on the Government to reverse the recent cuts in funding imposed on this exceptionally vulnerable yet invaluable sector of Irish life”

In response to both motions, Mr F. O’Driscoll Acting Senior Engineer stated the following:
A Litter Warden has been appointed since 29th March 2010 and is now working hard to catch these offenders. However we have no Environmental Awareness Officer at present, therefore we are relying on the local communities to play an active part in the prevention of this type of illegal activity.
26. REQUEST THE TAKING IN CHARGE OF ROAD IN ROSSES POINT VILLAGE:

“That Sligo County Council agrees to take in charge the third road to the right past Doherty’s Shop in Rosses Point Village going North, which runs parallel to the main road”
In response, Mr S. O’Toole, Senior Executive Engineer stated the following:
This road in Rosses Point will be examined by the Area Engineer to examine the feasibility of it being taken over. If this is a housing estate then our Enforcement Department will also be involved.
27. CLARIFY ISSUES IN STONEPARK ESTATE, BALLYMOTE:

“To call on Sligo County Council to clarify outstanding issues in Stonepark Estate, Ballymote”
In response, Mr J. Murphy, Senior Executive Officer stated the following:
This relates to the Castleburns estate in Ballymote.
2 no enforcement notices issued to the developer of this estate on 7th July 2009 requesting the carrying out of certain works to include (a) the provision of final road surfacing, pedestrian crossing, public lighting and road signs and markings and (b) the completion of landscaping.
The file was referred for legal action on the 13th November 2009 due to the failure of the developer to comply with the Enforcement Notices. The case stands adjourned to the Ballymote District Court on the 11th May 2010.
It was agreed that item 28 and item 41 be taken together.
28. PROVIDE PEDESTRIAN CROSSING ADJACENT TO FAIRGREEN RECREATIONAL FACILITY AT TEMPLE STREET, SLIGO:

“In light of the recent decision of this Council to assume control of the maintenance and upkeep of the National Primary Roads within the city of Sligo, I now ask as to who has responsibility for the maintenance and provision of road safety on the Pearse Road/MCR/Temple Street corridor. If it is determined that this matter is the responsibility of Sligo County Council, I ask that this Council would allocate funding for provision of a pedestrian crossing between St. Patrick’s Terrace and Temple Street adjacent to the entrance of the Fairgreen Recreational Facility. Further, I ask for an up-to-date report on the need for provision of other pedestrian crossings along the Pearse Road/MCR/Temple Street traffic corridor from the roundabout adjacent to Cleveragh Retail Park to the Cathedral of the Immaculate Conception”
In response, Mr T. Brennan, Senior Engineer stated the following:
Pearse Road/MCR/Temple Street is a regional road. Under the Roads Act the County Council of a County is responsible for all the regional roads within that County. The provision of a pedestrian crossing between St. Patrick’s Terrace and Temple Street is not due for consideration at this time. However, this matter will be given further consideration when the Fairgreen Recreational Facility works are carried out. The feasibility of providing additional pedestrian crossing along Pearse Road/mcr/Temple Street traffic corridor will be further investigated in 2010.
41. PROVIDE PEDESTRIAN CROSSING ADJACENT TO FAIRGREEN RECREATIONAL FACILTIY AT TEMPLE STREET, SLIGO:

“Recognising the significant difficulties which pedestrians, both young and old, have to cope with while crossing the R287 at Temple Street/St Patrick’s Terrace, Sligo, this Council resolves that a Pedestrian Crossing be provided in Temple Street near the proposed entrance to the Fairgreen Park and Recreation area”
A brief discussion took place on both motions 28 and 41 and members queries were answered. As agreement could not be reached the Cathaoirleach called for a vote on both motions.
