Mr Declan Breen A/DOS indicated that this report has been presented to the members following a review of the operation of the scheme which has been requested by the members at a earlier meeting of the Council.

15. AND 29. TRANSFER OF RESPONSIBILITY OF SLIGO HARBOUR:

Items 15 and 29 were both dealt with at this time.

The report of D. Breen A/DOS in relation to this Item was considered. The County Manger pointed out that plans for the construction of a Western By-pass needed to be finalised as this would be a critical issue for the Overall plan of the Harbour Area.

Declan Breen, A/DOS stated that it was the Councils intention to keep the harbour open and that the Council would ensure that there would be adequate level of staff provided for the operation of the harbour. It was also suggested that the work of the harbour authority should be acknowledged. Mr. Breen stated that arrangements were presently being finalised in relation to this”.

16. PLANNING CASE PL06/69:

As there was no seconder for Cllr Bree's motion the Motion Fell.

17. RELOCATION OF SLIGO FIRE STATION:

Cllr J. McGarry asked that Sligo County Council consider the relocation of Sligo Fire Station from St. Anne's to a site adjacent or close to Sligo's Mid Block Route as it would be more suitable particularly for incidents in North Sligo.

In reply, Ms D. Clarke, DOS said that the existing Fire Station at St. Anne's caters for the town area of Sligo and surrounding hinterland. Currently no site has been identified on or adjacent to the Inner Relief Road to deliver on this in the short term. However, in the long term and in keeping with the development of Sligo and as the demands for Emergency Services grows the Council should keep this under consideration.

The County Manager said that the amalgamation of the Fire Service, Ambulance Service and Gardaí was something that would be a major benefit. He agreed to write to Government Agencies to see if this can be developed however he said it was a long term target.

18. REPORT ON SEA CREST ESTATE:

Cllr J McGarry asked that Sligo County Council be provided with a full report on the taking in charge of Sea Crest Estate, Top Road, Strandhill, Sligo.

In reply, Mr J Murphy Senior Executive Officer said that planning permission for ten holiday apartments at Buenos Ayres, Carrowbunnan, Strandhill was granted by An Bord Pleanala on 9th May 2003 and the development is substantially completed. There are a number of matters still to be addressed including compliance with Condition 9 with regard to:-

  1. The submission of a landscaping scheme for agreement of the Council
  2. Carrying out of said landscaping

Some landscaping has been carried out at this location but this is not to the satisfaction of the council.

In addition, these landscaped areas are in a condition that does not allow for use of machinery for grass cutting due to deposition of construction waste etc thereon. A warning letter was issued by Registered Post to the developer on 18th May 2006 with regard to non compliance with Condition No.9. The Council met the developer on site on the 15th June 2006, and the Councils requirements were advised to him. Some landscaping was subsequently carried out, but is not to the satisfaction of the Council. The developer has been advised of this. The matter will be further reviewed post 12th July 2006. Finally, as you are aware, the taking in charge of estates is a matter for the members. Current policy does not permit the taking in charge of holiday home development. This issue will have to be addressed if the developer applies to have this estate taken in charge.

20. CENTRAL HEATING IN KIERNAN AVENUE, COLLOONEY:

Cllr J. McGarry asked that Sligo County Council indicate what Central Heating Programme is available to the Residents of Kiernan Avenue, Collooney and what time frame is there for its implementation.

In response, Ms D. Clarke, DOS said that it is proposed to install central heating to house numbers 20, 21, 27, 33, 35, 39, 40, 41, 42, 43, 46 and 47 at Kiernan Avenue, Collooney. Tenders are currently being sought from competent contractors and it is estimated that works will commence at the end of July and will be completed by the end of October 2006.

21. INSTALLATION OF SPEED RAMPS IN KIERNAN AVENUE, COLLOONEY:

Cllr J. McGarry asked that Sligo County Council indicate if there is any proposals in 2006 to install ramps in Kiernan Avenue, Collooney.

In response, Mr Gary Salter A/SE said that Sligo County Council installed speed ramps in Kiernan Avenue and two on the road adjacent in 2005. The estate has a 50Km/h speed limit and there are no funds available to provide further ramps in 2006.

22. DRAINAGE PROBLEMS IN KIERNAN AVENUE, COLLOONEY:

Cllr J. McGarry asked for a report on the drainage problems that exist at the back of Houses No 42-48 Kiernan Avenue, Collooney and what measures are proposed to deal with this problem.

In response, Ms D Clarke DOS said that this has been investigated and that at present there were no drainage difficulties, although some of the rear gardens may experience difficulties in periods of heavy rainfall.

Cllr McGarry said he received representations from two residents and he would pass on the names so that this can be investigated further.

19. PROPERTY AT MOYGARA, GURTEEN, CO. SLIGO:

Cllr D. Bree asked how and why the Council purchased a property in South Sligo, which was not constructed in accordance with planning permission and which is an unauthorised development under the Planning and Development Act.

Ms D. Clarke DOS gave the following reply:-

  • In September 2001, Sligo County Council agreed to purchase a site at Moygara, Gurteen, Co. Sligo from a developer – the intention was that the developer would construct a house on the site for the Council.
  • Full planning permission was received by the developer in respect of this dwelling house on 2 October 2000 – PL 00/966.
  • A Contract for the purchase of the site, and a building agreement for the construction of the house were entered into in October 2002.
  • The house was completed and allocated to a tenant in April 2004.

It is suggested that the house was not constructed in accordance with planning permission. In this regard, the Planning Enforcement Section carried out an inspection on 13th June, 2006, and reported as follows:

  • On inspection the dwelling house was found to be constructed substantially In accordance with the planning permission granted.
  • A fuel store was constructed instead of a garage, this was agreed with Sligo County Council as part of the contract.
  • The septic tank is constructed on the opposite side of the site to that shown on the layout drawing; however the percolation area appears to be substantially in the location shown. Given the location and nature of the site and from the inspection carried and in order to establish whether the septic tank and percolation area complied with SR 6 1991 it will be necessary to carry out the appropriate tests.
  • In relation to the issue regarding the shed and site boundaries there was an alteration to the site boundaries that occurred between the time the Planning application was lodged and the time the vendor agreed to transfer the sheds as part of the site to the Council. These were and are still in use and used by the vendor who owns all of the adjoining lands. The site transferred was somewhat longer and narrower that that on the planning permission map and the changes were agreed with Council staff at the time. The final site map was amended to reflect this.
  • Our legal advice has confirmed that while the change is technically outside the terms of planning permission it does not give rise to planning concerns. In the absence of such concerns our legal advisor has confirmed that there is no reason to take action at this time in view that the change was agreed with the Council’s representatives.

23. TRAFFIC CALMING MEASURES ON R297:

Cllr M. Barrett asked Sligo County Council to put traffic calming measures in place on the R297 between Rathlee National School and Rathlee Church.

In response, Mr G. Salter A/SE said that there was a proposal before the Council to impose a 60km/h speed limit in Rathlee and this should effect a reduction in speed through the village. The Council has also provided amber flashing lights on the approaches to the National School which further improves traffic safety in the area.

24. CANCER CARE CENTRES:

Cllr S. MacManus asked that Sligo County Council calls on the Department of Health and Children and the Health Service Executive (HSE) to ensure that Sligo General Hospital is selected as one of the eight "Cancer Centres" as proposed by the National Cancer Forum's report for delivery of cancer care throughout this state and further that we ask the same bodies to indicate a timescale for the delivery of these centres.

"That the proposal in relation to Sligo General Hospital being selected as one of the eight "Cancer Care" centres be amended to include a request from Sligo County Council for a meeting or meetings between the Department of Health and Children and the Health Service Executive and a deputation from this Council".

25. RIVERSTOWN COMMUNITY PARK:

Cllr M. Baker and Cllr G. Mullaney asked Sligo County Council to make a contribution to the Riverstown Community Park Development as requested by the committee.

That Sligo County Council make a contribution of €200,000 to Riverstown Community Park Development to be financed from the Financial Contribution Scheme.

26. BALLYMOTE LOCAL AREA PLAN:

With the agreement of the meeting this item was deferred to the September meeting as the map referred to in the motion had not been circulated.

27. TRAFFIC CALMING MEASURES IN BALLINTOGHER VILLAGE:

Cllr M. Baker asked Sligo County Council to put traffic calming measures in place in Ballintogher village.

In response, Mr G. Salter A/SE said that there is no proposal to provide traffic calming measures in 2006. Additional signage can be erected if there is a persistent speeding problem at any location. Amber flashing lights are in place at the National School and the village speed limit is 50km/h".

28. FUNDING FOR THE UPGRADING OF THE N16:

"That a joint meeting  will be held between Sligo and Leitrim County Councils within the next few months to plan a campaign to ensure that central government and the national roads authority put in place the necessary funding for the upgrading of the N16".

30. RECYCLING SERVICE IN SLIGO:

Seconded by Cllr D. Bree

Cllr V. Cawley asked that providers of recycling services in Sligo be requested to increase the number of times that the units are serviced as the current rate does not meet demand throughout Sligo.

In reply, Mr J McHugh Senior Engineer said that the Council has been in touch with REHAB – the company that collects glass and cans from 40 sites across the county and town. The frequency of visits to any site is normally dependent to its yield of glass or cans.

Rehab provides Sligo County Council with details of the tonnage of glass and cans picked up at all the sites across the County and Borough. Currently Sligo Town is divided into two areas, each being collected on alternative weeks, except for the bring banks at LIDL which are collected every week. In comparison Aclare has had 3 visits this year and Enniscrone has had 11 visits to date.

REHAB have indicated that they would be prepared to alter collection schedules where there is an issue of not enough collections. They can also provide additional bottle or can banks to increase capacity at problem sites.

The Council are also in the process of upgrading the bring banks in problem areas across the county in an attempt to make illegal dumping more difficult at sites".

31. RESTRICTION OF HGV'S IN HOUSING ESTATES IN THE COUNTY:

Cllr V. Cawley asked what progress has been made on the investigation into restriction of HGV in housing estates in the County”.

In response, Mr G. Salter SEE said that this matter had been considered by SPC3 - Transportation and Infrastructural Policy at a recent meeting. The Committee has decided following discussion to research further how best the problem can be managed and will present to the Council for discussion in the near future a 'draft policy paper'.

32. WELL AT KILFREE, GURTEEN, CO. SLIGO:

Cllr G. Murray asked Sligo County Council to examine the well in Kilfree, Gurteen, which was previously used to supply water to Gurteen Village as it is in a dangerous state and in urgent need of attention.

In reply Mr G. Salter, A/Senior Engineer said that arrangements have been put in place to carry out a technical and water quality inspection of this well and a decision will them be made on its future use.

33. PUBLIC ROAD BLOCKED OFF WHERE CITIZENS ARE DENIED VEHICULAR ACCESS TO THE ROAD:

Cllr D. Bree asked that in cases where a public road is blocked or closed off and where citizens are denied vehicular access to the road, that the Council will initiate legal proceedings against the person or persons responsible for closing the road.

In reply, Mr G Salter A/SE said that the Council will initiate proceedings in any case where there is wilful obstruction of a public road which has not been authorised by permission or consent, to restore the public right of way. A report will be prepared for the September meeting of the Council regarding Road L33081 at Cregg/Rosses Point.

34. TO MAKE PUBLIC HOSPITAL LAND AVAILABLE FOR PRIVATE HOSPITALS:

"That this Council condemns the Governments proposal to make Public Hospital land available for Private Hospitals and further the Council declares its outright opposition to a two-tier Public Health System".

35. DOUBLE LINES ON THE BALLINA ROAD OUT OF TUBBERCURRY:

Cllr M. Gormley asked that Sligo County Council place double yellow lines on the Ballina road out of Tubbercurry from junction where N17 meets out as far as the turn off to Basta.

In response, Mr G. Salter A/SE said that double yellow lines will be provided for an appropriate distance east and west of the junction on the R294 with the N17 – Tubbercurry Bypass in order to maintain sufficient sight-lines.

36. PLANNING CONDITIONS - DISABILITY FACILITIES:

Cllr D. Bree asked that in the interest of proper planning and development and to ensure that new facilities will be accessibility-proofed at design stage of development the following new condition be included in planning permissions granted by the Council: - "The developer shall ensure that the development conforms to the principles of universal design and takes cognisance of the needs of persons with mobility, sensory or intellectual impairments. The development shall comply with the guidance contained in ‘Building for Everyone – published by the National Disability Authority’ and shall include, inter alia, dished kerbs, tactile paving and accessible open spaces. The developer is required to consult with the Access Officer of Sligo County Council so as to ascertain the requirements in this regard.

Following consultation fully detailed drawings and an implementation scheme shall be submitted to the Planning Authority for its written agreement prior to commencement of development.

This Item was deferred with the agreement of the Meeting.

37. TRAFFIC CALMING MEASURES IN CALRY VILLAGE:

Cllr I. Fox asked Sligo County Council to provide traffic calming measures outside the Hall and Church in Calry Village.

In response, Mr G. Salter A/SE stated that this road has recently been upgraded in Class to a Regional Road. There are no proposals to provide traffic calming measures, however additional road signage on the approaches will be erected.

38. TABLE AND BENCH AT LAYBY ON R286:

Cllr I. Fox asked that the Community and Enterprise Department provide funding for table and bench at lay-by on Dromahair Road 286 overlooking Lough Colga”.

In response, Mr D. Breen A/DOS said that there are no funds available for this in the current year, however it will be looked at in the future.

39. EXTENSION OF FOOTPATHS IN CLIFFONEY VILLAGE:

Cllr I. Fox asked Sligo County Council to extend footpaths southwards form Cliffoney Village in the interests of public safety.

In response, Mr G. Salter A/SE stated that this footpath is along the National road route and funding therefore is a matter for the National Roads Authority. Some new footpaths have been provided as part of a traffic calming scheme and the Council will only be in a position to provide additional footpaths pending an allocation for that purpose from the NRA.

40. WASTEWATER TREATMENT IN CARNEY, CO. SLIGO:

Cllr S. Kilgannon asked for a progress report on the proposed improvements to the wastewater treatment infrastructure in Carney, Co.Sligo”.

In response, Mr K. Larkin Senior Engineer stated that tenders were received and evaluated for the construction of a Wastewater Treatment Plant at Carney. A recommendation on the successful tenderer is awaiting approval at present.

41. LOUGH TALT WATER SUPPLY:

Cllr M. Fleming asked Sligo County Council to seek funding from the Department of Environment to carry out a major scheme of upgrading of pipelines, fittings, and treatment Works of the Lough Talt Water Supply particularly in Tubbercurry where the old asbestos type mains are still in use as this water supply has been extended over the years to serve an increasing number of consumers.

In response, Mr K. Larkin stated that the Lough Talt RWSS has been approved by DoEHLG for the appointment of a Client’s Representative to bring forward proposals for, among other things:-

  • The provision of a new water treatment plant for the scheme
  • For an alternative back -up water supply source,
  • For the examination of the hydraulics of the scheme to determine how best to service the various subareas

As to the pipelines, under the Water Conservation Programme, for which a Client's Representative is already in place, a programme of works for the replacement of old, deficient and leaking mains has already been submitted to DEHLG for their approval. We await the outcome of that submission. Many of these pipelines are on the Lough Talt Scheme and in the Tubbercurry area.

In relation to asbestos any such pipes, that fall within the terms of reference as set out in the Water Conservation Programme described above, will qualify for replacement, but on the basis of their condition only.

42. DEVELOPMENT AND PROVISION OF SERVICES TO PEOPLE WITH SPECIAL NEEDS:

"The development and provision of services to people with special needs, particularly learning disability in the North West is curtailed severely because appointment of speech, occupational and physio therapists have not been sanctioned to date. 43. DISPOSAL OF PLASTIC:

Cllr M. Fleming asked Sligo County Council what plans are in place to assist farmers in County Sligo in collection and disposal of farm plastic as it is a major environmental issue.

In reply, Mr J. McHugh Senior Engineer stated that the Waste Farm Plastic Collection and recovery scheme is operated under an approval from the Minister for the Environment, Heritage and Local Government by a notfor- profit company called Irish Farm Films Producers Group Ltd (IFFPG). Its 9 member board represents silage sheeting and wrap trade, and includes two IFA nominees.

Funding for the scheme has been provided by members of IFFPG through a levy of €127 per tonne on sheeting and wrap (equivalent to approx 15cent per bale). It is reported that the cost of collecting and recycling waste silage sheeting and wrap is approximately €300 per tonne.

It is reported that the scheme could not meet the justifiable expectations and demands of its farmer customers for a quality service without further changes to its operations and additional funding. The Minister announced on May 3rd 2006 “The scheme was set up and funded on the basis of producers meeting a target of 50%. The target was exceeded by some 40% in 2005 when IFFPG collected and recycled 12, 500 tonnes of this waste. Due to the high demand the company were forced to suspend collection activities leaving a significant number of areas without collections”.

Following a meeting with IFFPG earlier this year the Minister announced changes to the collection scheme. The scheme will now operate as follows:

  • The current producer levy of €127 will remain unchanged.
  • The introduction of a weight-based collection fee of approximately €50 per pick up for the average farmer to be applied.
  • Certain counties which has a large back log of plastics were selected for inclusion in a “Spring Clean Pilot Project” whereby plastics would be collected at pick up points without incurring additional charges.

All Sligo farmers registered with IFFPG are due to receive a letter this week detailing the revised collection scheme. The IFFPG inform us that the collection of plastics from Sligo farmers is envisaged to recommence in the next few weeks. It is hoped that the spring clean scheme might be extended country wide but this decision rests with the Minister.

44. UPGRADING OF FOOTPATHS IN GURTEEN:

Cllr M. Gormley asked when would work commence on the upgrading of footpaths in Gurteen and would this work be contracted out.

In response, Mr P Hughes SEE stated that works are scheduled to be carried out in this location commencing in September and is likely to be undertaken by contract.

45. SLIABH GAMPH HOUSING ESTATE COLLANEY:

Cllr M. Gormley asked for an update on taking in charge of Sliabh Gamph housing estate in Coolaney.

In response, Mr S Concannon DOS stated that this was been addressed and the Council was in the process of taking this estate in charge.

46. PLANS TO SERVICE AREA (DRUMISKABOLE, OLD DUBLIN RAOAD):

Cllr G. Mullaney asked that Sligo County Council outline the plans to service the area at Drumiskabole (Old Dublin Road) which is zoned for logistics, warehousing and light industry in view of the fact that planning applications are held up due to lack of treatment plants and services. If Sligo County Council have plans to enter into a joint venture with private enterprise on this site"?

In response, Mr P. Forkan DOS stated that Sligo County Council does not have plans at present to provide sewers for waste water at this location. As much of the land is low lying and in some places tidal, it is not possible to treat effluent on site. It is however possible to service the land even though the ground conditions are difficult and there would be pumping requirements.

The funding of any scheme for this area would need to be secured from landowners in the area whose lands have been zoned for development resulting in dramatically increased land values in this area. Sligo County Council would consider a properly designed system with connection into the existing treatment works at either Ballisodare or Carraroe.

The best way forward would be for landowners in the area to agree to retain a design consultant to prepare a preliminary design and commit to the provision of a system which would need to be approved by the Council.

47. REALIGNMENT OF R287 AT CASTLELOWER, BALLINTOGHER:

Cllr G. Mullaney asked that Sligo County Council improve the realignment of Regional Road R287 at Castlelower, Ballintogher in the interest of public safety.

In response, Mr P. Hughes SEE said that there are no funds available to realign bends on the road at present. The Council have however strengthened a section with bitumen macadam at Correagh recently and proposes to strengthen in 2008 a further section of this road under the Multi Annual Restoration Improvement Programme.

48. TELECOMMUNICATIONS STRUCTURE AT CARROWNEE, BALLINACARROW:

Cllr P. McGrath asked Sligo County Council to refuse planning permission for a 25 metre telecommunications support structure carrying cellular antennas and link dishes plus associated telecommunications equipment container at Carrownree, Ballinacarrow.

In response, Mr P. Forkan DOS said that a planning application was lodged by 02 Communications (Ireland) Ltd on the 25th May 2006. The proposed development involves the erection of a 25m high telecommunications support structure at Doon Hill, Carrownee, Ballinacarrow, Co. Sligo. The planning application will be assessed in accordance with the provisions of Section 8.4.4 of the Sligo County Development Plan 2005 – 2011 which relates to telecommunications.
