ITEM 1; TO RESCIND MOTION AGREED AT ORDINARY MEETING OF SLIGO COUNTY COUNCIL HELD ON 12 SEPTEMBER 2005:
The Cathaoirleach, Councillor P. Barry indicated that copies of the two motions on the agenda together with the legal opinion of the Councils law agent had been circulated to the members with the agenda.
Mr H. Kearns, County Manager stated that legal advice had been received on the matter and circulated to the members. It is the opinion of the law agent of the Council that the proposed revocation of the resolution passed on 12th September 2005 is contrary to standing orders and unlawful.
The Cathaoirleach indicated that, not withstanding the legal advice received it was in the public interest that the matter would be debated openly in the chamber and that the issue be clarified for all. He asked that members would confine themselves to dealing with item one on the agenda at the outset.
Mr T. Carroll, Senior Engineer outlined the proposals relating to the proposed new junction at the N17 and the extinguishments of the two rights of way at this location. He pointed out that in the interests of road safety the National Roads Authority had provided funding for the proposal and that work had already commenced.
A number of members contributed to a discussion on this matter and following this discussion the Cathaoirleach, Councillor P. Barry ruled that the motion to rescind the resolution agreed at the meeting of Sligo County Council held on 12th September 2005 was out of order on the basis of legal advice received.
ITEM 2; PROVISION OF A STAGGERED JUNCTION AT RHUE CROSSROADS:
At the outset the Cathaoirleach, Councillor P. Barry indicated that an amendment to the motion on item two had been proposed by Councillor J. Lundy and seconded by Councillor A. Colleary as follows:
“That Sligo County Council provide the necessary works to make safe Rhue Cross. This work to be started immediately.
A number of members spoke on the motion and expressed their concerns relating to the question of safety at Rhue crossroads.
Mr T. Carroll, Senior Engineer stated that the sightlines on Rhue junction would be improved before the end of the year subject to the agreement of the adjacent landowner.
Mr H. Kearns, County Manager stated that a number of proposals for the improvement of Rhue crossroads would be prepared for discussion at the Tubbercurry area meeting to be held on 8 November 2005. He suggested that these would be discussed by the members with the local community and that the members could include provision for these works in the 2006 roadworks scheme. It was agreed that no decision would be made until such time as all options had been considered by the members.
