21. AGREEMENT WITH SLIGO BOROUGH COUNCIL FOR THE MAINTENANCE AND CONSTRUCTION OF NATIONAL & REGIONAL ROADS IN BOROUGH OF SLIGO:

23. HAZELWOOD /BALLINODE DRAFT LOCAL AREA: 

Mr B. Carolan, Acting Director of Services outlined the submissions received in relation to the Hazelwood /Ballinode draft local plan and also the Manager’s recommendations.

25. NOMINATION OF 3 MEMBERS TO THE JOINING UP DEVELOPMENT PROGRAMME:

“That Councillor A. Colleary and Councillor D. Healy McGowan be nominated to the ICBAN ‘Joining up Development’ programme and that Councillor S. Kilgannon be nominated as the external member to that committee”.

The appointment of Councillor S. Kilgannon was agreed.

As agreement could not be reached in relation to the filling of the two remaining positions the Cathaoirleach asked that a poll be taken.  It was agreed that ballot papers be circulated and members asked to indicate their preference for the filling of the two remaining positions.

As the result was 14 for Councillor Colleary, 10 for Councillor Fleming and 18 for Councillor Healy McGowan the Cathaoirleach declared Councillors Colleary, Healy Mc Gowan and Kilgallon appointed to the ‘Joining Up Development’ Programme.

26. FIXING DATE FOR HOLDING OF THE BUDGET MEETING:

“That the budget meeting 2005 would be held on 10th January 2005”.

27. FIXING OF DATE FOR DISCUSSION OF SUBMISSIONS RE. COUNTY DEVELOPMENT PLAN: 

It was agreed that the submissions relating to the second manager’s report on the County Development Plan would be considered at a meeting to be held on 29th November 2004 and that the mini plans would be considered at a meeting to be held on 13th December 2004.

28. GRAVEYARD AT CLOONA, ENNISCRONE: 

Councillor P. Conmy asked when work would start on the extension to the grave yard at Cloona, Enniscrone.

In response Director Clarke stated that tenders would be sought and that if adequate funds are available work will commence in 2005.

29. IMPLEMENTATION PLANS /PROPOSALS FOR STRANDHILL: 

Councillor J. Mc Garry asked that Sligo County Council in conjunction with Strandhill Development Association prepare an implementation plan, subject to finance being available, of works and developments to be carried out in Strandhill and that the implementation plans /proposals be taken from the Sligo County Council Development Plan.

In response County Manager H. Kearns advised that this was primarily a matter for the local communities and the private sector and that the Strandhill plan provides a framework within which proposals can be considered.

30. SUSPENSION OF STANDING ORDERS: 

Councillor P. Conmy asked that at the next meeting where a motion to suspend standing orders is put before the start of a meeting and is proposed and seconded that this Council propose that the Chairperson put that motion to the floor for Councillors to decide if standing orders should be suspended for an emergency debate as an emergency may arise at any time as standing orders clearly states that this can be done without informing anybody.

Following a discussion on the matter and consideration of standing orders it was agreed that the provisions in standing orders are sufficient to allow debate on urgent matters as necessary.

31. HEALTH BOARD OFFICES IN MANORHAMILTON & EXTENT OF NORTH WESTERN HEALTH BOARD AREA:

“That this Council call on the government not to downgrade the new health board offices in Manorhamilton and further call on the government not to go ahead with the decision to include North Tipperary, Clare and Limerick in what was the North Western Health Board area and call on Fianna Fail TD’s and Senators in Sligo /Leitrim to oppose this decision”.

32. PL 04/804; MAST AT TULLYNAGRACKEN SOUTH, CARRAROE: 

Councillor S. Mac Manus asked the County Manager to explain why PL 04\804 (An application from ESB\Telecom) ie. for the erection of a 36 metre freestanding structure at Tullynagracken South, Carraroe, was granted. Given that an amendment to the Sligo County Development Plan as adopted by Sligo County Council explicitly states that base stations and telecommunication masts should not be constructed within 400 metres of private dwellings, this permission appears to clearly contravene the Development Plan.

In response Mr B. Carolan, Acting Director of Services stated that as the County Development Plan is currently under review the decision to grant planning permission had been made under the Sligo & Environs Development Plan and in line with government guidelines.

“That Sligo County Council agrees that until such time as the new County Development plan becomes policy, the current County Development Plan will be considered as the premiere plan for all planning matters”.

33 & 54. ROSSES POINT MARINA: 

Councillor V. Cawley asked that in view of the on going problems with the Marina Project at Rosses Point that Councillors have an up to date report on the matter. 
In response Director Clarke stated that the Department of Maine and Natural Resources have received advice from the Attorney General’s office that their grant approval does not comply with EU rules on state aid.  The option open to the Department now is to apply for specific state aid approval, this could be a lengthy process and the Council will be kept informed of progress.

Councillor D. Bree asked if the Council has received an indication as to when the joint delegation is due to meet the Minister for the Marine in regard to the proposed Rosses Point Marina.

Director Clarke stated that no indication has been received as to when this meeting could take place.

34. WATER SAVING MEASURES IN LOCAL AUTHORITY HOUSING SCHEMES:

“That with the introduction of water charges for non domestic use of water in the county that this council should lead by example and use water saving measures such as dual flush toilets in all future local authority housing schemes”.

35. PEDESTRIAN LIGHTS AND EXTENSION OF FOOTPATHS IN DROMORE WEST: 

Councillor M. Barrett asked that this Council provide pedestrian traffic lights on the N59 opposite the community centre in Dromore West and extend the footpath from the village in Dromore West to the McGee Hall on the N59.

In response Mr T. Carroll, Senior Engineer stated that some measures can be considered to improve pedestrians safety along this section of route in the context of the 2005 roadworks scheme”.

36. SPEED LIMIT & FOOTPATH IN EASKEY: 

Councillor M. Barrett asked that this Council extend the speed limit and the footpath from the village in Easkey to the Seafield hotel on the regional road.

In response Mr T. Carroll, Senior Engineer stated that there will be a general review of speed limit zones in the County early in 2005.  He further stated that the question of extending the footpath in Easkey can be considered in the context of the 2005 roadworks scheme when it is being discussed at a local area meeting”.

37. MAIN BALLYMOTE JUNCTION ON N4 AT DRUMFIN: 

Councillor G. Mullaney asked that Sligo County Council provide funding for the improvement of the main Ballymote junction on the N4 at Drumfin.
In response Mr T. Carroll, Senior Engineer stated that it is proposed to include this junction for funding under the Low Cost Accident Reduction scheme in 2005, however the success of the scheme depends on the dedication of some private lands to the roads authority.

38. WATER MAIN FROM RIVERSTOWN TO TOWNAGH: 

Councillor G. Mullaney asked that in light of health and safety concerns that Sligo County Council immediately remove the asbestos water main from Riverstown to Townagh and replace it with suitable pipework.

In response Mr K. Larkin, Senior Engineer stated that there are no health and safety concerns with the use of A.C. watermains, which are used throughout Ireland for the conveyance of drinking water to the public.

39. BUSHY PARK, BALLISODARE: 

Councillor G. Mullaney asked that Sligo County Council provide an update on the progress made on the completion of all the outstanding work in Bushy Park, Ballisodare.

In response Mr D. Breen, Senior Executive Officer stated that an enforcement notice was issued for non compliance of planning conditions, the case is before the courts and has been adjourned to 25th November as works are underway on site to comply with the conditions of the enforcement notice.  The enforcement dept. have had meetings on site with the developer and the residents association in an effort to resolve outstanding matters.

40. RADON DETECTORS:

“That this council calls on the department of health to subsidise the cost of providing Radon detectors units in all houses in the Sligo and the North West area”.

41. AMBULANCE BASE IN SOUTH SLIGO & HEALTH CARE CENTRE AT COLLOONEY: 

Proposed by Councillor M. Gormley
Seconded by Councillor M. Fleming

AND AGREED

That this council calls on the North Western Health Board for the up-to-date position on the following;

  1. The provision of an ambulance base for South Sligo.
  2. The provision of the Health Centre at Coolaney”.

42. ROAD 111 AT EASKEY & ROAD 163 CARROWCARDEN: 

Councillor J. Queenan asked that Sligo County Council take in charge another 100m on road 111 at Easkey G.A.A. pitch and another 250m approximately on road 163 Carrowcarden.

In response Mr T. Carroll stated that taking over of any new section of rural roadway is not recommended at this time as the funds available for the maintenance of the local road system is inadequate, however it would be considered if the sections of road are brought up to an acceptable condition by the residents/ users in the area.

43. REMOVAL OF BENDS ON ROAD 163, 108 & 105B & CONSTRUCTION OF CARPARK AT KILLANLEY GRAVEYARD: 

Councillor J. Queenan asked the County Manager to allocate funding under Discretionary Improvement Grant to remove bends off road 163 Carrowcarden, road 108 Killanley and road 105B Castleconnor and to construct a car park adjacent to Killanley graveyard off road 108.

In response Mr T. Carroll stated that there are no funds available at present for the removal of bends, but that these proposals can be considered under Discretionary Improvement Grant 2005.  He further stated that there are no funds available for provision of a carpark at Killanley at present.

44. FOOTPATHS IN EASKEY: 

Councillor J. Queenan asked that funding be allocated for improvement to footpaths through Easkey village.

In response Mr T. Carroll, Senior Engineer stated that this can be included in the proposals to be considered under Discretionary Improvement Grant 2005.

45. SAFETY LIGHTING AT COOLA VOCATIONAL SCHOOL: 

Councillor M. Baker asked that Sligo County Council provide safety lighting at Coola Vocational School.

In response Mr T. Carroll stated that there are no funds available at present but that the provision of flashing lights can be considered under Discretionary Improvement Grant 2005”.

46. SEWERAGE SCHEME IN BALLINTOGHER: 

Councillor M. Baker asked for an update on the sewerage scheme in Ballintogher, is it at capacity and what are that plans for the future as it is a village that is expanding.

In response Mr K. Larkin, Senior Engineer stated the design load is 200PE and the current maximum load is just in excess of that, there are no plans to extend /upgrade the scheme in the short term.

47. CALRY ROAD 267: 

Councillor I. Fox asked that the Council call on the Minister for Environment to immediately provide additional funding for the urgent upgrading and resurfacing of the Calry Road 267.

In response Mr T. Carroll stated that 1.5km of the Calry road was strengthened in 2004 and it is proposed to strengthen a further 1.0km in 2005, subject to Department approval.

48. DRUMCLIFFE WATER SUPPLY: 

Councillor I. Fox asked about the position of the water scheme in Drumcliffe and whether the Council would extend it to the Clooneen area.

In response Mr K. Larkin, Senior Engineer stated that the North Sligo water supply scheme extends southwards as far as Drumcliffe and that the Drum East group water supply scheme extends northwards as far as the Sligo town side of Drumcliffe bridge, this scheme serves the Clooneen area it is to be upgraded and as such there is no immediate requirement to extend the north Sligo scheme to Clooneen.

49. CLOGHERMORE GRAVEYARD, CALRY: 

Councillor I. Fox asked for a detailed progress report regarding the development of the extension to the Cloghermore graveyard, Calry.

In response Director Clarke stated that work on the extension should be finished by the end of November 2004.

50. BUTLERS LANE, KILTYCAHILL: 

Councillor S. Kilgannon asked the Council to take in charge the road known as Butlers lane at Kiltycahill as only 200 metres are in the care of the Council at present.

In response Mr T. Carroll, Senior Engineer stated that there are no plans to take in charge any new sections of road at this time due to inadequacy of local road maintenance funding, however the council could consider taking the road in charge if the local residents/ users brought the road up to an acceptable standard.

51. FOOTPATH AT FAUGHTS LANE, CALRY: 

Councillor S. Kilgannon asked that the Council provide funding in the 2005 estimates for a footpath on Faughts lane.

In response Mr T. Carroll, Senior Engineer stated that this would be considered under the 2005 road works scheme.

52. WATER METERING AT NATIONAL SCHOOLS: 

Councillor M. Gormley asked that national schools be exempt from water charges.

In response Mr K. Larkin, Senior Engineer stated that there are three categories of consumers to be billed for water consumption under the government water pricing policy and that schools come into the category of non-domestic and cannot be exempted.

53. R292 AT BREEOGUE & ROUNDABOUT AT RANSBORO: 

Councillor D. Bree asked if the Council has proposals to eliminate the significant risk to pedestrians on the stretch of road between Ann Higgins house and Pauric Currans house in Breeogue and when the roundabout at Ransboro is intended to be completed as intended with kerbing at the corners and the replacement of the unsightly concrete fencing.

In response Mr T. Carroll, Senior Engineer stated that there are no funds available for the removal of bends on the R292 at Breeogue, this can be considered under discretionary improvement grant 2005.  The roundabout at Ransboro is substantially complete and it is not proposed to add further kerbing or to replace the fencing.

55. CARRAROE SEWERAGE SCHEME: 

Councillor D. Bree asked when work on the proposed new sewerage scheme for Carraroe is due to commence.

In response Mr K. Larkin, Senior Engineer stated that the Carraroe main drainage project is dependant on the Sligo main drainage project for treatment of foul sewage and as such it will be 2007 before Carraroe main drainage can go to construction.

56. FOOTPATHS ON OLD N4 FROM BALLISODARE TO COLLOONEY: 

Councillor J. Sherlock asked that the Council provide necessary finance to upgrade footpaths on old N4 from Ballisodare to Collooney.

In response Mr T. Carroll, Senior Engineer stated that the location can be included in proposals for consideration under Discretionary Improvements Grant 2005.

57. TRAFFIC CALMING MEASURES AT ENTRANCE OF KIERNAN AVENUE, COLLOONEY: 

Councillor J. Sherlock asked that the Council put in place traffic calming measures on the road passing the boys national school in Collooney at the entrance to Kiernan Avenue in the interests of public safety.

In response Mr T. Carroll stated that it is proposed to install improved road markings at this location to compliment the school signs already in position.

58. BALLYMOTE ROAD OUT OF TUBBERCURRY: 

Councillor M. Gormley asked that the council call on Atlantic Developments to immediately make safe the Ballymote road out of Tubbercurry.

In response Mr T. Carroll, Senior Engineer stated that Atlantic Developments have again been instructed to carry out reinstatement of the trench and work had commenced on Thursday 28th October 2004.

59. CHRISTMAS LIGHTING IN BALLYMOTE: 

Councillor P. Mc Grath asked that provision be made in the estimates for renewal of the grant for Christmas lighting in Ballymote.

In response Mr H. Kearns, County Manager stated that there is no provision in the budget for Christmas lighting as this is considered to be a matter for local communities.
