The members expressed a vote of sympathy to Pat Forkan on the death of his mother in law and to Elizabeth Henry on the death of her husband.
With the permission of the Cathaoirleach, Councillor M. Gormley and a number of other Councillors queried the deplorable condition of water in Gurteen and asked that immediate action be taken to remedy the matter.

The members welcomed the willingness of Mr Ian Lumley, the Heritage Office of An Taisce to attend the October 2003 meeting they also suggested that we request An Taisce to invite the two local representatives of An Taisce to the meeting.
23. ADDENDUM TO SECOND MANAGERS REPORT ON THE SLIGO AND ENVIRONS DRAFT DEVELOPMENT PLAN – SUBMISSION NO. 286:

24. RECOMMENDATIONS OF SPECIAL COMMITTEE RE ONE OFF HOUSES IN RURAL SLIGO:

That the following amendment be made to the written statement of the County Development Plan for the County of Sligo 1999-2004.
“As the term “speculative” was creating concerns among the members, it was agreed that Section 4.3, page 23 of the County Development Plan be amended as follows:
Line 35…………delete the word “non-speculative”
Line 41………insert "e.g. Clar areas" after "threat"
Lines 41 and 42…..delete “…, the development of sites for sale in a speculative way will be discouraged” and insert after "…merits”, “the carrying capacity of the landscape in absorbing new development will be the determining factor”.

“That the future use by the Planning Authority of S. 47 Agreements under the Planning and Development Act, 2000, will not apply to the landowners full holding, but only to relate to a specified area of land in agreement with the Planning Authority. This agreement to be subject to a letter of undertaking from the landowners’/ developers’ legal representatives to register the Agreement as a burden on the title to the lands”.

“That the future use of occupancy conditions would only be used to grant planning permissions, when otherwise refusal was being contemplated in a sensitive location, for a son or daughter of the landowner. In other exceptional circumstances an occupancy condition could be used to grant permission when otherwise refusal was being contemplated to a member of the local community”.
25. DECOUPULED PAYMENT FOR YOUNG FARMERS:
Deputy J. Perry asked that Sligo County Council call on the government to ensure that the young farmers who started farming after December 2000 will be entitled to decoupled payment in the European Commission proposal for the mid-term review of the Common Agricultural Policy.
This was agreed.
26. CUL DE SAC MONIES:
It was agreed at Councillor Queenan’s request that this item be withdrawn.
27. BUS EIREANN TIMETABLE:
Councillor J. Queenan asked that Sligo County Council call on the Minister for Transport to agree with Bus Eireann in the Sligo and Ballina offices that the time table regarding the Dublin route should be altered to facilitate passengers taking the ferry.
28. SEWERAGE SCHEMES FOR ACLARE AND COOLANEY:
Councillor M. Fleming requested information on the present position of sewerage schemes proposed for Aclare and Coolaney villages.
In response Mr K. Larkin, Senior Engineer stated that the planning process, site investigations and archaeological assessment for the Aclare Sewerage Scheme had been completed and it was hoped to go to tender in the next few weeks.
With regard to the sewerage scheme in Coolaney, he stated that this is a private development for which planning permission was granted in July, the decision to proceed with the development and the timing of the development is a matter for the applicant.
29 HIGHER EDUCATION GRANTS:
Councillor Michael Fleming asked that we seek clarification from the Minister for Education on his proposals as regards the maximum value of Higher Education Grants, the increased income limits of parents and when the application forms will be available.
The Higher Education Grant Scheme (item 21), circulated to members prior to the meeting, contained details regarding the value of the grant and income limits, application forms had been made available in late June.
30. STRATEGIC RAIL REVIEW:

“That this Council reject the Strategic Rail review carried out by B.A.H. and request the Minister for Transport to improve the infrastructure of the West by opening up the Sligo to Limerick railway line”.

34. KNOCKAGORE BRIDGE NO. 567:
Deputy J. Perry asked that Sligo County Council in partnership with Iarnrod Eireann immediately carry out works on the Knockagore Bridge no. 567 or provide an alternative route to ensure that emergency personnel have access.
In response Mr S O’ Toole, Acting Senior Engineer stated that the Divisional Engineer from Iarnrod Eireann attended the Ballymote Area meeting on 11th July, 2003 to discuss the matter and stated that it would be unreasonably expensive to widen the bridge. Mr O’ Toole agreed to pursue the possibility of providing an alternative access route with Iarnrod Eireann.
35. LINK ROAD AT CHURCH VIEW, COLLOONEY:
Deputy J. Perry asked that Sligo County Council carry out works on the link Road at Church View Road in Collooney, as it is used heavily and also serves the school.
In response Mr S O’ Toole, Acting Senior Engineer stated that this link road had been included in this years road restoration programme and that it was hoped that surface dressing works would be carried out in the near future.
36. GOVERNMENT PROPOSALS RE. HEALTH SERVICES:

“That Sligo County Council condemn the government on the recent proposals in the Health Services as the North Western Health Board is one of the most efficient Health Boards in the Country”.
As agreement was not reached on the matter the Cathaoirleach, Councillor PJ Cawley asked that a poll be taken.

40. LAY-BYES ON R294 AT LOUGH TALT:

In response Mr S O’ Toole, Acting Senior Engineer stated that works would be undertaken as part of the Road Works Scheme in the current year.
41. FREE TRAVEL SCHEME:

42. SLIGO /DUNDALK MOTORWAY (N16):

“To ask the Manager for clarification of the current position re. Sligo /Dundalk motorway (N.16). What are the findings of survey carried out by the N.R.A. regarding re-alignment of the route proposed. There are a number of planning decisions hinging on the proposed route and some people are anxious to know where they stand in this regard”.
In response Director Concannon stated that a study on the proposed east link had been carried out in 2001 on behalf of the NRA and some sections of the route are scheduled for improvement, but none of these are in County Sligo. The Sligo to Manorhamilton section of the N16 is scheduled for improvement in 2019. He advised that decisions on planning applications in the area of this route would be dealt with on a case by case basis.
43. BENDS ON ROAD 106 AT KILLANLEY:
Councillor J. Queenan asked that Sligo County Council allocate funding to upgrade road and remove bends on Road 106 at Killanley.
In response Mr S O’ Toole, Acting Senior Engineer advised that it would be considered for funding under the Discretionary Improvement Grants proposals for 2004.
44. UPGRADING OF ROAD TO EASKEY CHURCH:
Councillor J. Queenan asked that Sligo County Council to allocate funding for upgrading of road to Easkey RC Church.
In response Mr S O’ Toole, Acting Senior Engineer stated that this road would be considered for inclusion in the proposals for Class III roads in the current year.
45. QUALITY OF WATER FROM RIVER MOY FLOWING ON TO BEACH AT ENNISCRONE:
Councillor J. Queenan asked the County Manager to confirm that the quality of water from River Moy flowing on to the beach at Enniscrone qualifies with blue flag status.
In response Ms E. Concannon, Senior Executive Engineer advised that to date this season, the overall bathing quality results in Enniscrone conform with the Blue Flag water quality criteria and also that eleven water samples had been taken in intervals from the beach at the Moy Estuary to the shoreline at the Councils sewage treatment plant, and the findings do not indicate a deterioration in bathing water quality towards the Moy river.
46. SPEED LIMIT AT KILROSS:
Senator E. Scanlon asked that the Council erect a speed limit of 40mph at the Kilross side of the existing speed limit on the road which runs between Kilross and Ballintogher.
In response Mr S O’ Toole, Acting Senior Engineer stated that the speed limit signs around Ballintogher village and the location on the Kilross side of Ballintogher will be considered under the next review of speed limits.
47. INSURANCE FOR PLAYGROUND IN BALLYMOTE:
Senator E. Scanlon asked that the Council provide insurance for a new playground in Ballymote as there are no outdoor child facilities at present in the town.
In response, R. Lavin, Financial Management Accountant stated that the Council does not have the resources necessary to adhere to the conditions involved in insuring playgrounds. He advised that the Councils premium for public liability has risen from €360,000 in 2002 to almost €500,000 in 2003.
Director Caffrey advised that numerous discussions had taken place between the Head of Finance and the IPB on this issue but that it is not feasible with present resources. He stated that we would again contact IPBMI on the issue.
48. FOOTPATHS IN BALLYMOTE:
Senator E. Scanlon asked that the Council make repairs to the footpaths in Keenaghan and Grattan Street, from Wolfe Tone Street to Corhober, Ballymote.
In response Mr S O’ Toole, Acting Senior Engineer advised that work on footpaths at Emmet Street in Ballymote is complete. He stated that there are not funds available in the current year for work at Keenaghan, Grattan Street or Wolfe Tone Street to Corhobber, but that these can be considered for funding under the Discretionary Improvement Grant 2004.
49. LONGFORD HOUSE, BELTRA:
Councillor M. Barrett asked that Longford House, Beltra, Co. Sligo be removed from the list of Buildings and Structures to be preserved as outlined in appendix 6 of the County Development Plan 1999-2004. She stated that her reason for raising this matter was the present poor and unstable condition of the building.
In response Director Forkan stated a submission for delisting Longford House had been received as part of the current County Development Plan review. He informed the meeting that the matter could be dealt with in conjunction with the review or alternatively the Council could proceed under Section 55 of the Planning and Development Act, 2000 which requires informing the Minister for the Environment, Heritage and Local Government of the proposal that Longford House be removed from the list of protected structures. The Council agreed to the proposal to the delisting of the building and to proceed immediately in accordance with the legislation.
50. UPGRADING OF SEWERAGE SYSTEM IN ENNISCRONE:
Councillor P. Conmy asked for a report on the proposed upgrading of the sewerage system in Enniscrone.
In response Mr K. Larkin, Senior Engineer stated that the upgrading of the sewage treatment works at Enniscrone is included in the Water Services Investment Programme 2003 –2005 and is due to go to construction in 2004. A preliminary report was sent to the DOEHLG in April 2002. In July of this year a further information was requested. It is expected that this information will be sent to the DOEHLG in early September 2003. He advised that the scheme cannot go through the preliminary stage until approval of the preliminary report has been received.
56. SPEED LIMIT AT TONNAFORTES:
Councillor J. Mc Garry asked that Sligo County Council request that the speed limit sign at Tonafortes, Carrowroe, Sligo, be reduced from 40mph to 30mph.
In response Mr S O’ Toole, Acting Senior Engineer did not recommend a further speed limit reduction for this area at this time.
60. DEVELOPMENT POTENTIAL OF TOWNS ALONG THE DISUSED SLIGO –LIMERICK RAIL LINE:
Deputy J. Devins asked the County Manager to report on the development potential of towns and villages along the disused Sligo –Limerick railway line, such as Collooney, Tubbercurry and Curry, in light of recommendations that suitable development in such towns would hasten the reopening of the railway line.
Director Clarke advised that four of the gateways named in the National Spatial Strategy are along the western corridor. For Sligo town to maximise its potential as a gateway it is vital that an adequate transport system is in place. Collooney has been designated for urban development as part of the County Development Plan 1999 –2004. Tubbercurry and Curry offer expansion potential also.
